2023120420240115European Institution/Agency or International OrganisationContract noticeServicesNot specifiedEuropean Institution/Agency or International OrganisationNot specifiedNot specifiedEC3021.IntroductionEuropean Commission, Office for Infrastructure and Logistics in Brussels (OIB), Bruxelles, BelgiumThe European Union, represented by the European Commission, itself represented by the Director of the Office for Infrastructure and Logistics in Brussels (hereinafter ‘the Commission’), is the owner of 77 parking spaces in the basement of the ‘Arlon-Trèves’ property complex located at rue de Trèves 80-90 and rue d"Arlon 53-61, including 72 spaces on level -1, 4 spaces on level -3 and 1 space on level -4). This concerns a co-owned property containing 421 spaces for motor vehicles, distributed over 5 underground levels. Each private parking space is accompanied by a share in the common areas. According to the environmental permit in force, the 77 locations in question are currently ‘in excess within the meaning of Article 2.3.51.4 of the Ordinance establishing the Brussels Air, Climate and Management Code of Energy (‘CoBRACE’). As a result, since 16 September 2022, they have been subject to the environmental charge within the meaning of Articles 2.3.55 – 2.3.62 of CoBRACE.These parking spaces are not occupied.

2.SubjectThe Commission intends to resell the 77 parking spaces described above in a single lot and in their current state.

3.ProcedureThe sale of tangible assets of the Union is governed by Article 87(2) of Regulation (EU, Euratom) 2018/1046 of the Parliament and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union (the ‘Financial Regulation’):https://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:32018R1046&qid=1689629721376This procedure is organised in two stages:1. Call for applications: economic operators interested in acquiring all 77 parking spaces in a single lot and in their current state (without guarantee of apparent or hidden defects) are invited, by this call for applications, to submit a request to participate. This first stage aims to select candidates who meet the criteria set out in this publication;2. Invitation to submit a tender: only successful candidates will be invited to submit a tender.

4.ApplicationsTo be selected as eligible candidates for the submission of a tender, interested economic operators, must:— not be in any of the exclusion situations referred to in Article 136 of the Financial Regulation (solemn declaration form relating to the exclusion criteria available on request by sending an e-mail to OIB-PIMM@ec.europa.eu),— not be subject to sanctions adopted under Article 29 of the Treaty on European Union or Article 215 of the Treaty on the Functioning of the EuropeanUnion;— in the case of a company or other legal person, be established in one of the EU Member States or – in the case of a natural person – have the nationality of one of the EU Member States,— have submitted a compliant application.In the case of a grouping without legal personality, all the members of the grouping must meet the above-mentioned conditions.To be considered compliant, the application must be:— made using the application form (available on request by sending an e-mail to OIB-PIMM-OFFRE@ec.europa.eu), duly completed and signed (in the case of an application on behalf of a company or another legal person, it must be represented in accordance with its articles of association, or by virtue of an official power of attorney, signed by the person(s) authorised to commit the same),— submitted no later than 15 January 2024 by e-mail to the address OIB-PIMM-OFFRE@ec.europa.eu,— accompanied by the following documents (available on request at the address OIB-PIMM-OFFRE@ec.europa.eu):• solemn declaration relating to the exclusion criteria,• confidentiality declaration for access to details relating to the spaces offered for sale and to their visit.(In the case of a grouping without legal personality, all the members of the grouping must complete their own declaration.)Economic operators considered ineligible, or whose application does not comply, will be informed by e-mail within ten working days. If the non-compliance is minor, the Commission will invite them to take the necessary corrective measures within five working days.Successful candidates will receive the documents relating to the property to be sold (in particular: town planning information; copy of the title deed; basic deed of co-ownership). They will also be authorised to visit the property.

5.TendersSuccessful candidates will be invited to submit a tender within four weeks of the invitation, without prejudice to the right of the European Commission to proceed with the evaluation of the tenders upon receipt of all the expected tenders.The template for the deed of sale will be annexed to the invitation to submit a tender to purchase.To be compliant, the tender must be:— unconditional,— signed (in the event of acquisition in the name of a company or other legal person, it must be represented in accordance with its articles of association, or by virtue of an official power of attorney, signed by the person(s) authorised to commit the same),— submitted by e-mail to the address OIB-PIMM-OFFRE@ec.europa.eu, within the deadline indicated in the invitation letter to submit a tender,— equal to or greater than EUR 2 117 500 (i.e. EUR 27 500 per space), expressed in euros, excluding all duties, costs and taxes relating to the transfer of ownership, it being understood that all of these rights, costs and taxes will be at the expense of the buyer,— valid for at least three months from the expiry of the deadline set for the submission of tenders,— accompanied by an irrevocable and unconditional bank guarantee for an amount equal to 10% of the amount of the tender, callable on first request, for a minimum period of three months from the expiry of the deadline set for the submission of tenders.In the absence of a qualified electronic signature, the Commission reserves the right to subsequently require the tender and the bank guarantee to be signed manually.The opening of tenders will not be public. On the day following the deadline for tendering, or on the day following receipt by the Commission of all the tenders, the latter will be examined with regard to their compliance.Any non-compliant tender will be rejected. The Commission will consider the highest compliant tender. The candidate(s) whose tender has been rejected and/or whose tender is not the highest will be informed without delay and the bank guarantees provided by these candidates will be released.The candidate whose tender is accepted by the Commission will be informed as soon as possible, and at the latest within the month following the expiry of the deadline set for the submission of tenders. This candidate will be deemed to unconditionally consent to the conditions set out in the draft deed of sale. In the event of a tender submitted by a group without legal personality, the members will be jointly and severally bound by the said conditions.The deed of sale must be signed within the month following the date on which the Commission informs the candidate that its tender has been accepted. The bank guarantee provided by this candidate will be released upon signature of the official deed of sale.This publication does not in any way constitute a commitment by the Commission. The Commission reserves the right, until the deed is signed, to cancel this procedure without economic operators being able to claim any compensation.
