VII.1.4)Description of the procurement:

An der A 4 Ost Autobahn sollte ursprünglich zwischen Bruck/West und Neusiedl/Gewerbepark eine Fahrstreifenerweiterung durchgeführt werden. Die Projektsteuerung steht der Projektleitung zur Seite und koordiniert die Planung im genannten Abschnitt. Aufgrund der ausständigen Entscheidungen zur Umsetzung der ursprünglich geplanten Verbreitung soll nun aufgrund des Fahrbahnzustandes eine Deckensanierung umgesetzt werden. Daher wird die Meng der Position 1.1.09 erhöht.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Aufgrund der ausständigen Entscheidungen zur Umsetzung der ursprünglich geplanten Verbreitung soll nun aufgrund des Fahrbahnzustandes eine Deckensanierung umgesetzt werden. Daher wird die Menge der Position 1.1.09 erhöht.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die gegenständliche Änderung war trotz gebotener Sorgfaltspflicht für den Auftraggeber nicht ersichtlich. Ein Wechsel des Auftragnehmers ist aus technischen und wirtschaftlichen Gründen nicht möglich, da die gegenständliche Vertragsänderung in einem engen wirtschaftlichen bzw. technischen Zusammenhang mit dem ursprünglichen Auftrag steht. Zudem würde ein Wechsel des Auftragnehmers für den Auftraggeber zu erheblichen Schwierigkeiten in der Auftragsabwicklung führen, da eine zeitliche Unterbrechung des Auftrages die termingerechte Realisierung des Projektes gefährden und auch unzählige Schnittstellenprobleme aufwerfen würde. In weiterer Folge wäre der Auftraggeber auch mit beachtlichen Zusatzkosten aufgrund von Einarbeitungen, Vorbereitungsmaßnahmen, unvermeidbare Parallelbearbeitung bzw. allfälligen Stehzeiten konfrontiert.
