Verlängerung des Wartungsvertrages aufgrund unvorhergesehener Verzögerungen in der Neuausschreibung des Auftrages

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Aufgrund unvorhersehbarer Umstände hat sich die Neuausschreibung eines entsprechenden Wartungsvertrages verzögert. Diese steht jedoch kurz vor dem Abschluss. Zur Überbrückung der Zeit bis zum Abschluss des neuen Vertrages musste der laufende Wartungsvertrag verlängert werden, da gesetzlich vorgegeben ist (StrabVO), dass eine redundante Verbindung zwischen Fahrzeug und Leitstelle bestehen muss, weshalb für die Aufrechterhaltung des Betriebes eine Störung möglichst schnell behoben werden muss. Das durch den Wartungsvertrag zu wartende RBL-Netzwerk zählt damit zur kritischen Infrastruktur, weshalb ein Aussetzen der Wartung aus technischen und rechtlichen Gründen nicht möglich ist.
