PRE-SOLICITATION NOTICE: THE NAVY INTENDS TO AWARD A NEW DELIVER ORDER UNDER A BASIC ORDERING AGREEMENT.
INTRODUCTION
The Naval Air Systems Command (NAVAIR) at Patuxent River, MD (V2242) intends to negotiate and award a new delivery order under Basic Ordering Agreement (BOA) N0001920G0007 on a sole source basis to The Raytheon Company (Raytheon) for the repair of Multi Module Redesign Group B (MMR-B) test assets for the APG-79 AESA Radar System. This delivery order will allow NAVAIR to rapidly repair MMR-B test assets in the event that the MMR-B flight test modules experience a hardware failure. This effort is required to support MMR-B flight tests being conducted by various squadrons throughout Calendar Year (CY) 2024 and early in CY 2025. Raytheon is the sole designer, developer, and manufacturer of the APG-79 AESA radar system. The Government does not possess a technical data package with Government Purpose Rights for the APG-79 AESA Radar System. This data package is required in order to repair the MMR-B test assets. In addition, Raytheon is the only firm with the design knowledge and technical expertise required to perform these repairs. As such, NAVAIR has determined that Raytheon is the only responsible source capable of meeting the Government’s minimum needs.
This acquisition is being pursued on a sole source basis to Raytheon (CAGE 4U884) under the statutory authority of 10 U.S.C. 2304(c)(1)] as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements”. As the incumbent contractor, Raytheon has the manufacturing knowledge, experience, and technical data required to fulfill this requirement within the time required.
The Government does not intend to use the provisions of FAR part 12 for this acquisition.
