NAICS – 811210 Electronic and Precision Equipment Repair and Maintenance, with a business size standard of $34M.

This is a Notice of Intent, not a request for proposal. The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) intends to negotiate on an other than full and open competition basis with Newport Corporation, in Santa Clara, California to procure a maintenance agreement on the Newport Spectra Physics lasers and software on the Confocal Microscopy equipment and imaging software. The period of performance is May 1, 2023 – April 30, 2024, for the equipment listed below.

The statutory authority for this sole source requirement is 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements. THIS IS NOT A REQUEST FOR PROPOSAL. All responsible sources that could provide comparable services may submit a capability statement that will be considered by email (subject line to reference NOI-NIAID-23-2161732) to Jesse Weidow at jesse.weidow@nih.gov, by 11:00 am eastern standard time Tuesday, April 25, 2023. All responses received by the closing date of this synopsis will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.

The purpose of this acquisition is to provide a maintenance agreement for the above referenced equipment to maintain it in optimal operating condition. National Institute of Allergy and Infectious Disease (NIAID), National Institutes of Health (NIH) has a requirement for a (1) one Year service agreement on (8) eight Newport Spectra Physics Lasers, Ultrafast Oscillators.

Capability Statements MUST address the following requirements: All service terms, conditions, and exclusions as a part of the service, shall be included as an attachment to the capabilities statement.

• All equipment must be quoted separately and in the same order as the equipment list attached.

• Period of Performance must be included.

• Unlimited service visits by guaranteed OEM technicians.

• Unlimited guaranteed OEM Replacement service parts, components, or modules necessary for repairs, excluding 3rd party items and consumables.

• Proprietary Software Updates.

• Guaranteed On-site priority response time - 5 business days.

• Priority scheduling and onsite response for all repairs during the period of performance. Priority is defined as giving priority scheduling equal to a direct contract and guaranteeing the equivalent manufacturer’s priority onsite response.

• All equipment must be listed separately and in the same order as the equipment listed above. If not in same order as the equipment listing, the capability statement will not be reviewed.

• If you are a third-party service provider, the priority scheduling and/or response time, must be listed on your capabilities statement. *MUST INCLUDE CERTIFICATION DOCUMENTATION FROM THE MANUFACTURER, CONFIRMING A BILLABLE CONTRACT SERVICE IS OF EQUAL SERVICE AS A DIRECT CONTRACT, INCLUDING PRIORTY RESPONSE TIME*

Capabilities statement must include response to all minimum service requirements, and all instructions for the quote, for the offer to be accepted as responsive. The Contractor shall provide all necessary parts and equipment necessary to perform remedial repair and planned maintenance of the above equipment, which are house within a Biosafety Level 2 facility. All service terms, conditions, and exclusions as a part of the quoted service, shall be included as an attachment to the quotation. Referenced or linked terms and conditions will not be considered nor considered for award.
