Identification of the project:

Cofinanciado a través de los Fondos Next Generation EU, en concreto dentro del Programa de Planes de Sostenibilidad Turística en Destinaciones ( PSTD), subvenciones destinadas a la transformación digital i modernización de las administraciones de las entidades locales, convocatoria extraordinaria 2023, promovida por el Ministerio de Industria, Comercio y Turismo.

Estas ayudas están financiadas con recursos procedentes del PRTR, Plan de Recuperación, Transformación y Resiliencia, en el desarrollo de las actuaciones necesarias para la consecución de los objetivos definidos en el componente 14, inversión 1, del mencionado PRTR.

Explanation:

La Directiva 2014/24/UE del Parlamento Europeo y del Consejo, de 26 de febrero de 2014, sobre contratación pública y por la que se deroga la Directiva 2004/18/CE, establece las normas para la adjudicación de contratos públicos en la Unión Europea. En particular, el artículo 32 de la Directiva establece las condiciones en las que se pueden adjudicar contratos sin publicación previa en el Diario Oficial de la Unión Europea.

En este sentido, el artículo 33, establece que los contratos pueden adjudicarse sin publicación previa en el Diario Oficial de la Unión Europea cuando se trate de contratos basados en un acuerdo marco. Además, el artículo 33 establece que los contratos basados en un acuerdo marco pueden adjudicarse sin publicación previa en el Diario Oficial de la Unión Europea siempre que se cumplan ciertas condiciones.

Debido al carácter específico y especializado del servicio, los servicios objeto del contrato requieren un conocimiento técnico y especializado único, que solo un número limitado de proveedores posee. La adjudicación a través de un Acuerdo Marco facilita la selección de proveedores especializados y asegura la excelencia y eficiencia en la prestación de estos servicios específicos.

Por lo tanto, si el acuerdo marco cumple con las condiciones establecidas en la Directiva, es posible adjudicar contratos basados en el mismo sin publicación previa en el Diario Oficial de la Unión Europea.
