SUPPLY, INSTALLATION AND COMMISSIONING OF A SCANNING PROBE MICROSCOPE AND OPTICAL SPECTROSCOPY UNDER ULTRA-HIGH VACUUM AND CRYOGENIC TEMPERATURE CONDITIONS FOR ICN2

The contract for the supply, installation and commissioning of a scanning probe microscope and optical spectroscopy under ultra-high vacuum and cryogenic temperature conditions for the Institut Català de Nanociencia i Nanotecnologia (ICN2), is expected to meet the need of such object for the characterization of structural, electronic, optical, magnetic and mechanical properties of materials with an exceptional simultaneous resolution in space and time.
The equipment in question must meet the specific requirements regulated in the Technical Specifications. Specifically, the equipment will consist of an SPM operating at low temperature, ultra-high vacuum (UHV) conditions and subject to magnetic field, specially modified for the introduction and collection of light. Such equipment allows spectroscopic and topographic characterization with atomic resolution of material surfaces, by means of STM and nc-AFM (scanning tunneling microscopy and non-contact atomic force microscopy) measurements.
In turn, the vacuum part of the SPM contains the optical elements necessary for the implementation of tunneling and optical spectroscopic measurements in in-operating conditions, including static and time-resolved STM electro- and photoluminescence, and tip-enhanced Raman scattering. All this allows the characterization of structural, magnetic, electronic and optoelectronic properties of material surfaces, at space and time scales simultaneously accessible only through such unique equipment. Within the framework of the In-CAEM project, this SPM will be integrated into a comprehensive ecosystem of characterization instruments for materials, designed to perform correlative measurements using different characterization techniques. For this purpose, the sample holder and sample transfer systems under UHV conditions will be compatible with those of the LOREA, CIRCE and BOREAS lines of the ALBA Synchrotron.

This contract is financed by the European Union"s Recovery and Resilience Mechanism, established by Council Regulation (EU) 2020/2094 of 14 December 2020 establishing a European Union Recovery Facility to support recovery from the COVID-19 crisis, and regulated under Regulation (EU) 2021/241 of the European Parliament and of the Council of 12 February 2021 establishing the Recovery and Resilience Mechanism, and will be subject to all the regulations governing the Recovery and Resilience Mechanism.
It is framed within the implementation of the Complementary R&D&I Plans with the autonomous communities, which are part of component 17 of the Recovery, Transformation and Resilience Plan, called "Institutional reform and strengthening of the capacities of the National Science, Technology and Innovation System", specifically in the R&D SUBPROJECT "IN-SITU CORRELATIVE INSTALLATION FOR ADVANCED MATERIALS FOR ENERGY (In-CAEM)" OF THE COMPLEMENTARY PLAN IN THE AREA OF ADVANCED MATERIALS as part of the actions of the Advanced Materials program "Materials amb funcionalitats avançades per a la nova transformació tecnològica", corresponding to the autonomous community of Catalonia, managed through the Departament de Recerca i Universitats de la Generalitat de Catalunya (Department of Research and Universities of the Generalitat de Catalunya).

Natural or legal persons, Spanish or foreign, who have full capacity to act in accordance with the provisions of Article 65 of the LCSP, who are not included in any of the prohibitions on contracting set forth in Article 71 of the aforementioned Law and who demonstrate the solvency required in this Folder and enjoy the business or professional qualification that, where appropriate, is required to carry out the activity or provision that constitutes the object of the contract, may contract with the contracting entity. The requirements of capacity, solvency and absence of prohibitions to contract must be met at the time of submission of the bid and must be maintained until the time of award and formalization of the contract.
A) Economic and financial solvency Article 87.1 of the LCSP. The bidder must comply with the following conditions:
- Statement on the annual turnover, which referring to the year of the highest turnover of the last three years concluded must be at least one times the estimated value of the contract, equivalent to: 750,000.00 € (seven hundred and fifty thousand euros).
This shall be evidenced by the completion and presentation of the DEUC attached to the PCP of the procedure as Annex No. 1.
B) Technical or professional solvency: Article 91 of the LCSP. The bidder must comply with the following conditions:
- A list of the main supplies of the same or similar nature to those that are the object of the contract made in the last three years including amount, dates and the recipient, public or private, of the same. These supplies or works shall be evidenced by certificates issued or countersigned by the competent body if the recipient is a public sector entity or, when the recipient is a private entity, by a certificate issued by the latter. In the absence of certificates, they may be accredited by means of a declaration by the entrepreneur.
Entrepreneurs will have to attest to having executed, during the year of greatest execution of the indicated period, an amount (excluding taxes) greater than 70% of its average annual amount, for an amount of: 525,000.00 € (five hundred and twenty-five thousand euros).
This will be accredited by means of the completion and presentation of the DEUC attached to the PCP of the procedure as Annex No. 1.
The following are established as special conditions of contractual performance:
- The commitments assumed by the successful bidder in its bid in relation to sustainable public procurement.
- Maintenance of the working conditions of the people executing the contract throughout the contract period: The contractor company must maintain, throughout the execution of the contract, the labor and social conditions of the workers employed in the execution of the contract, set at the time of submitting the bid, according to the applicable agreement.
- The successful bidder assumes, as a special condition of execution, the obligation to apply to the staff executing the contract the working conditions established by the latest sectorial agreement in force in which the contractual service is framed and developed, without prejudice to any improvements that may be established.

A special appeal in contracting matters regulated in article 44 and following of theLCSP may be filed before the Catalan Public Sector Contracts Court as the competent body for the resolution of the appeal, against the tender announcement, the bidding documents and the contractual documents that establish the conditions that must govern the contracting, as well as the procedural acts adopted in the awarding procedure, provided that the latter decide directly or indirectly on the award, determine the impossibility of continuing the procedure or produce defencelessness or irreparable damage to legitimate rights or interests, the acts by which the admission or rejection of candidates is agreed, including the offers that are excluded for being abnormally low as a result of the application of article 149 of the LCSP, against the award agreement and the contractual modifications based on the non-compliance with the provisions of articles 204 and 205 of the LCSP.
Likewise, a special appeal may be filed in the cases provided for in Article 39.2 of the LCSP. Alternatively, a contentious administrative appeal may be filed, in accordance with Law 29/1998, of July 13, 1998, regulating the contentious administrative jurisdiction.
The special appeal in contracting matters is optional. The time limit for filing the special appeal in contracting matters is ten calendar days and is computed in the manner established in Article 50.1 LCSP, in accordance with Article 58 of Royal Decree Law 36/2020, of December 30, by which urgent measures for the modernization of the Public Administration and for the execution of the Recovery, Transformation and Resilience Plan are approved.
