Decreto de Alcadía 2023-5523 de 10 de octubre de 2023...." Primero.- Avocar el presente acuerdo en esta Alcaldía por las razones que constan en la parte expositivaSegundo.- Aprobar la modificación del contrato SAN JAVIER DESTINO TURÍSTICO INTELIGENTE "SMART CITY" EDUSI, formalizado el 3 de octubre de 2022, por importe de 325.000,00 € IVA excluido, con la mercantil PAVAPARK MOVILIDAD SL, con CIF B98552847, en base a las necesidades puestas de manifiesto en la solicitud del contratista y en el informe del responsable del contrato.Tercero.- Proceder a la formalización de la modificación del contrato, conforme a lo dispuesto en el artículo 153 de la LCSP 2017 y publicar el anuncio de modificación en el perfil de contratante del órgano de contratación, en el plazo de 5 días desde su aprobación.Cuarto.- Notificar el presente acuerdo al contratista y comunicarlo a Intervención, Tesorería, al responsable del contrato y a la Agencia de Desarrollo Local."...

VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

La razón por la que es necesario incluir la modificación prevista viene determinada porque durante la ejecución del contrato se ha producido, por motivos ajenos e inesperados para el Ayuntamiento, la retirada de las cabinas telefónicas en una decisión unilateral de la empresa que las gestionaba, por lo que es imposible cumplir con las condiciones previstas en la cláusula citada.Respecto de las condiciones exigidas para esta modificación:1º No introduce modificaciones que hubiera permitido la selección de un candidato distinto de los seleccionados inicialmente ni por sus características hubieran atraído mas licitadores al procedimiento, en concreto, de la inclusión de la modificación propuesta no resultaría una clasificación de contratista distinta a la que se exigió en el contrato inicial.2º La modificación no altera el equilibrio económico del contrato en beneficio del contratista, puesto que el importe de la unidad nueva propuesta asciende a 9.477,00 €, mientras las contempladas en el pliego original ascendían a 8.740,00 €, sobre un precio del contrato inicial de 325,000 € IVA excluido.3º La modificación no amplía de forma importante el ámbito del contrato:
