         El licitador tendrá que acreditar, para el medicamento incluido en su oferta, su inscripción en el Registro de Medicamentos de la Agencia Española de Medicamentos y Productos Sanitarios y que poseen autorización de comercialización, código nacional y fijación de precios para el mismo, otorgados por las autoridades sanitarias competentes.

         Asimismo, deberá aportarse certificado emitido por el laboratorio comercializador de que el medicamento licitado se encuentra efectivamente comercializado en España a fecha fin de presentación de ofertas continuando hasta la fecha previa a la adjudicación.
