   1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
         List and brief description of conditions:

         Todas las empresas y establecimientos alimentarios deben estar registrados según lo establece la normativa europea relativa a la higiene de productos alimenticios (Reglamento CE n.º 852/2004 del Parlamento Europeo y del Consejo de 29 de abril), y dependiendo del sector de alimentación y de la fase de la cadena alimentaria en que se desarrolle la actividad, procede la inscripción en el registro sanitario nacional o en el registro sanitario autonómico.

         Así, de conformidad con lo dispuesto en la cláusula 10.7 “Documentación previa a la adjudicación” letra a) punto 3 del presente PCAP, los licitadores deben aportar:

         - Documentación acreditativa de la inscripción en el Registro que legalmente proceda: Registro General Sanitario de Empresas Alimentarias y Alimentos (RGSEAA), Registro Sanitario de Empresas y Establecimientos Alimentarios de Andalucía, o Registro de Comerciantes y Actividades Comerciales de Andalucía, según disponen, respectivamente, el Real Decreto 191/2011, de 18 de febrero, sobre Registro General Sanitario de Empresas Alimentarias y Alimentos; el Decreto 61/2012, de 13 de marzo, por el que se regula el procedimiento de la autorización sanitaria de funcionamiento y la comunicación previa de inicio de actividad de las empresas y establecimientos alimentarios y se crea el Registro Sanitario de Empresas y Establecimientos Alimentarios de Andalucía; y el Decreto 164/2011, de 17 de mayo, por el que se regula la organización y funcionamiento del Registro de Comerciantes y Actividades Comerciales de Andalucía.

         - En los casos en los que la actividad para la que esté inscrito sea Distribución sin almacenamiento (sin instalaciones), deberá aportar relación de proveedores habituales inscritos en el registro sanitario nacional o autonómico, según proceda.

         - El contratista deberá manifestar, mediante declaración responsable, que su actividad no se encuentra suspendida cautelarmente en virtud de medida adoptada por las Autoridades Sanitarias o sus agentes, en aplicación de lo dispuesto en los artículos 21 y 23.1.d) de la ley 2/1998, de 15 de julio de Salud de Andalucía, y 83 de la Ley 16/2011, de 23 de diciembre, de Salud Pública de Andalucía. De igual modo, deberá declarar responsablemente no haber sido sancionado por Resolución firme con motivo de la comisión de infracción sanitaria grave o muy grave en los últimos cinco años.
