VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Esta obra de Sustitución de Desvíos tiene un plazo de ejecución de 4 meses, y se realizará mediante un TBA que finalizará en mayo de 2023. Estando su ámbito de ejecución incluido en el ámbito de ejecución de la obra objeto de la presente solicitud de ampliación de plazo.

Para realizar una sola puesta en servicio conjunta entre las dos actuaciones es necesaria la ampliación de plazo de la obra de señalización y por tanto de la Asistencia Técnica.

La licitación del actual contrato de asistencia se aprobó con fecha 14 de febrero de 2020, por lo que en dicho momento no se podía prever las circunstancias sobrevenidas durante el desarrollo de la obra y que motivan la modificación del presente contrato de Asistencia Técnica.

La modificación que se está planteando no altera la naturaleza global del contrato, pues su resultado es un contrato de la misma naturaleza que el celebrado en un principio, cuyo objeto es la prestación de servicios de asistencia para la ejecución del apoyo técnico al Director de Obra, para el seguimiento y control de la correcta ejecución de las obras según la normativa vigente. Los trabajos objeto de este modificado seguirán consistiendo en el seguimiento y control de las obras actualmente en ejecución del Proyecto Constructivo BLAU con CTC Arahal – Fuente de Piedra.

La parte del presupuesto de la modificación propuesta, solicitado por causas imprevistas asciende a 122.524,63 €, que supone el 27,76% del precio del contrato primitivo, inferior por tanto al máximo del 50% del precio inicial, IVA excluido.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Durante la ejecución de los trabajos y con fecha 08/06/2022, Adif ha contratado la actuación: OBRAS DE EJECUCIÓN DEL PROYECTO CONSTRUCTIVO DE SUSTITUCIÓN DE DESVÍOS TIPO A POR TIPO P EN LAS ESTACIONES DE MARCHENA, OSUNA Y PEDRERA. LÍNEA DE BIFURCACIÓN UTRERA – FUENTE DE PIEDRA. Contrato nº: 3.21/27507.0296 (actuación MRR código RC504).Esta obra de Sustitución de Desvíos tiene un plazo de ejecución de 4 meses, y se realizará mediante un TBA que finalizará en mayo de 2023. Estando su ámbito de ejecución incluido en el ámbito de ejecución de la obra objeto de la presente solicitud de ampliación de plazo.Para realizar una sola puesta en servicio conjunta entre las dos actuaciones es necesaria la ampliación de plazo de la obra de señalización y por tanto de la Asistencia Técnica.
