VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Pri naročniku se je po sklenitvi pogodbe in aneksa št. 1 pojavila potreba po zakupu dodatnih 80 licencah, pri čemer je naročnik možnost dodatnega zakupa licenc predvidel tudi v točki II. obrazca ePRO - Specifikacije, druga alineja poglavja Funkcionalne zahteve do projektnega informacijskega sistema;

Zaradi zakupa dodatnih licenc in vzdrževanja le-teh (postavka 2.b Vzdrževanje projektnega informacijskega sistema skladno s točko II. obrazca ePRO - Specifikacije) je potrebno spremeniti (povečati) tudi pogodbeno vrednost, pri čemer pa je izvajalec za zakup dodatnih licenc ponudil cene, ki so nižje od tistih v pogodbi, za storitve vzdrževanja (mesečni pavšal) pa cene, ki so enake cenam iz pogodbe in tako za naročnika gospodarne;

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Pri naročniku se je izkazala potreba po dodatnih storitvah, pri čemer bi zamenjava izvajalca naročniku povzročila velike nevšečnosti in znatno podvajanje stroškov (uvedba novega izvajalca, podvajanje posamezne vrste pripravljalnih in drugih storitev za izvedbo dodatnih storitev, itd.). Izvedba posamezne vrste storitev iz pogodbe predstavlja zaključeno celoto, obstoječi izvajalec pa je v delo (izvedba storitve projektne pisarne) že uveden in pozna značilnosti izvedenih storitev, zaradi česar so odmiki pri zaključku del optimizirani. Prav tako zamenjava izvajalca iz vidika sorazmernosti glede na sklenjen aneks št. 2 k pogodbi iz ekonomskih razlogov ne bi bila smiselna.
