                                      1. Confidenţialitate: OE vor elabora ofertele în conformitate cu prevederile documentaţiei de atribuire şi vor indica, motivat, în cuprinsul acestora, care informaţii din propunerea tehnică şi/sau propunerea financiară sunt confidenţiale, clasificate sau sunt protejate de un drept de proprietate intelectuală conform legislaţiei aplicabile. 2. AC are dreptul să solicite în original orice document cu regim special a cărui valabilitate este condiţionată de prezentarea în această formă. 3. Documentelor transmise prin mijloace electronice le sunt aplicabile prevederile legale referitoare la semnătura electronică (Legea nr. 455/2001, cu modificările și completările ulterioare). Astfel, documentele ofertei, DUAE, documentele de calificare, orice alte documente justificative, precum şi, după caz, răspunsurile la solicitările de clarificări, se transmit conform solicitării AC, prin intermediul SEAP, în mod obligatoriu semnate cu semnătura electronică extinsă, bazată pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat, fiind considerate documente originale. Documentele emise de instituţii/ organisme oficiale abilitate trebuie să fie semnate şi parafate conform prevederilor legale, urmând ca semnătura electronică extinsă, bazată pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat, aparţinând OE să fie aplicată de acesta asupra copiei respectivului document. 4. DUAE va fi completat conform Instructiunilor prezentate in anexa nr. 1 din Ordinul Presedintelui ANAP nr.1017/ 2019 (prin exceptie, in cazul in care DUAE-ul este generat direct in SEAP, nu este necesara prezentarea acestuia semnat cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat). 5. Datele cu caracter personal solicitate în prezenta procedură, sunt prelucrate în conformitate cu prevederile Regulamentului nr. 679/2016. Scopul prelucrării datelor cu caracter personal este cel stabilit de îndeplinirea obligațiilor instituite de legislatia privind achizițiile publice, iar durata de prelucrare a acestora este perioada derulării procedurii, cât și cea ulterioră acesteia, în conformitate cu actele normative in vigoare. 6. Dacă în urma procesului de evaluare a ofertelor, doi sau mai mulţi ofertanţi sunt clasaţi pe primul loc, achizitorul va solicita numai ofertanţilor aflați în această situație depunerea de noi propuneri financiare în SEAP. Ofertanţii în cauză nu au decât dreptul de a îmbunătăţi propunerea financiară depusă anterior, urmând ca oferta declarată câştigătoare să fie cea al cărei nou preţ, reofertat, este cel mai scăzut. Dacă şi în urma reofertării în SEAP, ofertanţii nu vor putea fi departajaţi, vor deveni incidente prevederile art. 212 alin. (1) lit. c) din Legea nr. 98/2016, privind achizițiile publice, cu modificările și completările ulterioare, iar procedura de atribuire va fi anulată, fiind imposibilă încheierea contractatului. 7)Plata produselor se va efectua in termen de maxim 30 de zile de la instalarea si punerea in functiune, In conformitate cu prevederile Legii nr. 72/2013. 8)Posibilitatea retragerii sau modificarii ofertei: Ofertele sunt declarate intarziate daca nu au fost postate in SEAP in termenul stabilit. Retragerea ofertei este posibila numai inainte de data limita stabilita si postata in SEAP. 9)Operatorul economic castigator are obligatia ca pana la data semnarii contractului sa aiba sau sa si deschida cont la Trezoreria Statului, in conformitate cu OMF 2254/2006 privind modificarea si completarea Ordinului ministrului finantelor publice nr.1235/2003 pentru aprobarea Normelor metodologice de aplicare a prevederilor OUG nr.146/2002 privind formarea si utilizarea resurselor derulate prin Trezoreria Statului, aprobata cu modificari prn Legea nr.201/2003. 10)Conditii pentru participantii la sedinta de deschidere: Ofertantii pot fi prezenti in cadrul sedintei de deschidere in baza unei scrisori de imputernicire. 11) Nu se accepta oferte alternative. 12) Documentul Unic de Achizitie European, link care poate fi accesat la adresa: https://ec.europa.eu/growth/tools-databases/espd/filter NOTA: Modul in care se poate accesa DUAE in vederea completarii de catre operatorii economici interesati: accesare link-ului: https/ec.europa.eu/growth/tools-databases/espd/filter. Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.
