        NOTA: Autoritatea contractanta nu va raspunde solicitarilor de clarificari/informatiilor suplimentare care nu au fost adresate in termenul stabilit la pct. 1 invocat mai sus.

        Eventualele raspunsuri la clarificari se vor atasa la anuntul de participare.

    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        1. Ofertantii, tertii sustinatori si/sau subcontractantii nu trebuie sa se regaseasca in situatiile prevazute de art. 164, 165 si art. 167 din Legea nr. 98/2016.

        Modalitatea prin care poate fi demonstrata indeplinirea cerintelor: Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

        Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

        Aceste documente pot fi:

        1) Certificate constatatoare privind lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (bugetul de stat, bugetul local, etc.), valabile la momentul prezentarii lor.

        2) Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au puterea de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/act constitutiv.

        3) Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166, alin.2, art. 167, alin. 2 si art. 171 din Legea nr. 98/2016 privind achizitiile publice.

        4) Alte documente edificatoare, dupa caz.

        Pentru ofertantii straini: Documente edificatoare pentru dovedirea eligibilitatii, eliberate de autoritatile competente ale tarii in care acestia sunt rezidenti (certificate, caziere judiciare, alte documente echivalente), privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor si contributiilor catre bugetul de stat si bugetul local, fiind transmise online si trebuind sa fie valabile la data prezentarii lor.

        2. Ofertantii, tertii sustinatori si/sau subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 59 si art. 60 din Legea 98/2016. In acest sens, se va completa si se va atasa in SEAP o declaratie pe propria raspundere.

        In scopul prevenirii situatiilor de natura sa determine aparitia unui conflict de interese si/sau manifestarea concurentei neloiale, cf. art. 59 si 60 din Legea nr. 98/2016, persoanele care detin functii de decizie în cadrul autoritatii contractante sunt:

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

        Modalitatea de indeplinire: Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

      1. Prezumtia de legalitate si autenticitate a documentelor prezentate: Ofertantul îsi asuma raspunderea exclusiva pentru legalitatea si autenticitatea tuturor documentelor prezentate în original si/sau copie în vederea participarii la procedura.

      Analizarea documentelor prezentate de ofertanti de catre comisia de evaluare nu angajeaza din partea acesteia nicio raspundere sau obligatie fata de acceptarea acestora ca fiind autentice sau legale si nu înlatura raspunderea exclusiva a ofertantului sub acest aspect.

      2. Oferta si documentele se depun on-line, semnate cu semnatura electronica extinsa, sub sanctiunea respingerii ofertei ca inacceptabila, in baza art. 137, alin. 2 din HG 395/2016.
