                        Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.

                        Analiza documentelor prezentate de ofertanti de catre comisia de evaluare nu angajeaza din partea acesteia nicio raspundere sau obligatie fata de acceptarea ca fiind autentice sau legale si nu inlatura raspunderea exclusiva a ofertantului sub acest aspect. Orice operator economic înregistrat în SICAP are dreptul de a transmite oferta. Atât elementele propunerii tehnice specifice produselor cât si elementele propunerii financiare sunt transmise în SICAP de catre operatorul economic. Oferta va fi depusa în SICAP. Nu se accepta oferte alternative. Neprezentarea propunerii tehnice sau/si financiare are ca efect descalificarea ofertantului. Se vor respinge ofertele care au fost depuse dupa data si ora limita de depunere sau la o alta adresa decât SICAP. In cazul in care in urma aplicarii criteriului de atribuire, sunt doua sau mai multe oferte cu acelasi pret, departajarea se va realiza prin transmiterea online a unei solicitari de clarificari din partea autoritatii contractante privind o noua oferta de pret, la care ofertantii vor transmite raspunsul lor online(in SICAP) semnat cu semnatura electronica extinsa.

                        DUAE se va completa in SICAP. Operatorii interesati pot afla informatii suplimentare despre utilizarea DUAE accesand linkul http://anap.gov.ro/web/notificare-privind-utilizarea-duae-in-procedurile-desfasurate-exclusiv-prin-mijloace-electronice. Toate documentele se vor depune in SICAP semnate cu semnatura electronica extinsa, conform art.60, alin.(4) din HG nr.395/2016. Orice solicitare de clarificari referitoare la prezenta documentatie de atribuire si pe tot parcursul derularii procedurii, se vor adresa în mod exclusiv în SICAP la sectiunea "Întrebari" din cadrul procedurii de atribuire derulata prin mijloace electronice, iar raspunsurile la acestea vor fi publicate în SICAP la sectiunea "Documentatie si clarificari" din cadrul anuntului de participare semnate cu semnatura electronica extinsa, autoritatea contractanta urmând sa nu dea curs solicitarilor adresate prin alta modalitate de comunicare decât cea stabilita.

                        Formularele la care se fac referiri in prezenta documentatie se regasesc in sectiunea "LISTA DE FISIERE CARE COMPUN DOCUMENTATIA DE ATRIBUIRE - FORMULARE".
