  3. Section III
    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        Cerinta nr. 1 – Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art. 164, 165, 167 din Legea nr. 98/2016.

        Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire (inclusiv eventualii terti si subcontractanti) cu informatiile aferente situatiei lor.

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE vor fi:

        1. certificate constatatoare emise de ONRC;

        2. cazier judiciar;

        3. alte documente edificatoare, dupa caz.

        Operatorii economici nerezidenti (straini) au dreptul de a prezenta orice documente edificatoare, eliberate de autoritatile din tara in care acestia sunt rezidenti. Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmi la finalizara evaluarii ofertelor.

        Cerinta nr. 2 – Ofertantii, tertii sustinatori, subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art. 60 din Legea nr. 98/2016.

        Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire (inclusiv eventualii terti si subcontractanti) cu informatiile aferente situatiei lor.

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv declaratia privind neincradrarea situatiilor prevazute la art. 60 din Legea 98/2016 va fi prezentata de toti participantii, odata cu depunerea DUAE.

        Persoanele cu functie de decizie din cadrul autoritatii contractante, in ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire, sunt:

        1. Director General – dr. Patricia Visan

        3. Presedinte comisie evaluare – dr. Visan Patricia

        4. Membru comisie evaluare – Matei Madalina

        Nedepunerea DUAE odata cu oferta (inclusiv pentru asociat/tert sustinator) atrage respingerea acesteia ca inacceptabila.

        Nedepunerea odata cu oferta, a DUAE, a angajamentului ferm al tertului sustinator din care rezulta modul efectiv în care se va materializa sustinerea acestuia, sau dupa caz, a acordului de subcontractare si/sau a acordului de asociere, atrage respingerea acesteia ca inacceptabila.

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmi la finalizara evaluarii ofertelor.

        Toate documentele trebuie sa fie valabile la momentul prezentarii acestora.

        Cerinta nr. 1 – Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul acordului-cadru.

        Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire (inclusiv eventualii terti si subcontractanti) cu informatiile aferente situatiei lor.

        Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC.

        In cazul ofertantilor nerezidenti (straini), autorizatiile /documentele justificative echivalente emise în tara de rezidenta. Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmi la finalizara evaluarii ofertelor.

        Cerinta nr. 2 - Operatorii economici ce depun oferta trebuie sa detina:

        a) Autorizatia de distributie angro eliberata de MS – Agentia Nationala a Medicamentului - Dovada avizarii unitatii pentru activitati de procurare/comercializare, activitati de detinere (depozitare)/manipulare, livrare/transport sub contract, a medicamentelor de uz uman prin prezentarea Autorizatiei de distributie angro eliberata de MS – ANM, in conformitate cu dispozitiile art. 800 alin. (1) din Legea nr. 95/2006, republicata, si ale art. 2 din normele la Ordinul nr. 131/2016 pentru aprobarea Normelor privind autorizarea unitatilor de distributie angro de medicamente de uz uman, certificarea de buna practica de distributie si înregistrarea brokerilor de medicamente de uz uman.

        b) Autorizatie de punere pe piata a produsului, conform Legii nr. 95/2006 privind reforma in domeniul sanatatii, cu modificarile si completarile ulterioare (art. 700 (1) si (2), art. 730 (5), Titlu XVII, Medicamentul), Ordinelor MSF nr. 263/15.03.2003 si nr. 895/20.07.2006; Regulamentului (CE) nr. 726/2004 al Parlamentului European si al Consiliului din 31 martie 2004 de stabilire a procedurilor comunitare privind autorizarea si supravegherea medicamentelor de uz uman si veterinar; Regulamentului (CE) nr.1234/2008 al Comisiei din 24 noiembrie 2008 privind examinarea modificarii conditiilor autorizatiilor de introducere pe piata acordate pentru medicamentele de uz uman si veterinar.

        Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire (inclusiv eventualii terti si subcontractanti) cu informatiile aferente situatiei lor.

        In cazul ofertantilor nerezidenti (straini), autorizatiile/documentele justificative echivalente emise în tara de rezidenta. Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.
