        Ofertantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016

        Precizam ca persoanele cu functii de decizie din cadrul entitatii contractante sunt: Daniel Paicu , Iacob Andreica, Claudia Tatar

        ,DanaAlexandra Pop, Razvan Horgos , Tomoiaga Ioan, Ligiu Zah, Marcel Cosma ,Veronica Maris.

        Modalitatea prin care poate fi demonstrata îndeplinirea cerintei:

        - Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea

        autoritatii

        contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

        Aceste documente justificative pot fi:1.• certificate constatatoare privind lipsa datoriilor RESTANTE cu privire la plata impozitelor,

        taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;

        2.• cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al

        respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum

        rezulta din

        certificatul constatator emis de ONRC / actul constitutiv;

        3.• dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art.

        166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice; 4.• alte documente edificatoare, dupa caz.

        Pentru persoanele juridice straine:Se vor depune documente echivalente emise in tara de rezidenta.

        Cerinta nr. 1Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, din care

        sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si

        faptul

        ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate prin care poate fi demonstrata

        îndeplinirea

        cerintei:

        - se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei

        lor.Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis

        de

        ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta, urmeaza sa fie prezentate, la solicitarea

        autoritatii contractante, doarde catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

        Informatiile din certificatul constatator trebuie sa fie REALE/VALIDE LA DATA PREZENTARII ACESTUIA.

        Cerinta 2.Ofertantul/candidatul trebuie să aibă dreptul de a presta serviciile prevăzute la Art. 62 pct. 2) din Codul Silvic, care

        precizează că „ Exploatarea masei lemnoase se face doar de operatori economici atestati de către comisia de atestare, care

        functionează în cadrul asociatiei patronale si profesionale din domeniul forestier recunoscută la nivel national ”. Se va completa

        DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Document solicitat

        operatorului economic clasat pe primul loc in clasamentul intermediar: Certificat de atestare/reatestare eliberat de Comisia de

        Atestare a Operatorilor Economici în Activitatea de Exploatare Forestieră si Cazier tehnic de exploatare. Informatiile cuprinse în

        aceste documente trebuie să fie reale/valabile la data limită de depunere a ofertelor si să rezulte că ofertantul/candidatul are

        capacitate de exploatare rămasă disponibilă conform Certificatului de atestare în exploatare pentru volumul pentru care licitează.

      Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin

      trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de

      fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.a) Autoritatea Contractanta are dreptul de a

      solicita ofertantilor, in circumstante exceptionale, inainte de expirarea perioadei de

      valabilitate a ofertei, prelungirea acestei perioade.

      b) ofertantul are obligatia de a comunica Autoritatii Contractante daca este sau nu este de acord cu prelungirea perioadei de valabilitate a

      ofertei.

      c) ofertantul care nu este de acord cu prelungirea perioadei de valabilitate a ofertei se considera ca si-a retras oferta, fara ca acest fapt sa

      atraga pierderea garantiei de participare.Limba de redactare a ofertei - Romana.

      Toate certificatele si documentele emise in alta limba decat romana vor fi insotite de traducerea autorizata a acestora in limba romana.

      In cazul in care operatorii economici participanti la procedura de atribuire uzeaza de drepturile prevazute la art 193 din Legea 98/2016

      prin

      completarea DUAE, documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la

      solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I.

      Solicitarile de clarificari ale potentialilor ofertanti se vor adresa in mod exclusiv in SICAP la Sectiunea ”Intrebari” din cadrul procedurii de

      atribuire derulate prin mijloace electronice iar raspunsurile la acestea vor fi publicate in SICAP, la Sectiunea ”Documentatie si Clarificari”

      din cadrul anuntului de participare, entitatea contractanta urmand sa nu dea curs solicitarilor adresate prin alta modalitate de comunicare

      decat cea stabilita in conformitate cu prevederile art. 64 alin. (1) din Legea nr. 98/2016 pentru comunicarile ulterioare depunerii ofertelor.

      Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SICAP la Sectiunea “Intrebari”. Operatorii economici

      vor

      transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SICAP (Sectiunea

      “Intrebari”),

      integral in sectiunea corespunzatoare respectivei solicitari, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu

      semnatura electronica.

      In cazul in care se constata ca ofertele clasate pe primul loc au preturi egale, in vederea departajarii ofertelor, entitatea contractanta (prin

      intermediul SICAP la Sectiunea “Intrebari”) va solicita reofertarea, prin prezentarea unei noi propuneri financiare. Noua propunere

      financiara va fi depusa doar si numai in urma solicitarii entitatii contractante.Ofertantul va prezenta o declaratie prin care accepta clauzele

      contractuale

      cuprinse în modelul de contract din documentatia de atribuire.

      Daca un operator economic considera ca anumite clauze contractuale îi sunt în defavoarabile, poate solicita autoritatii contractante

      clarificari, inclusiv modificarea lor, astfel încat daca aceste clauze vor fi amendate/modificate ele sa fie aduse la cunostinta tuturor

      operatorilor economici interesati, înainte de data limita de depunere a ofertelor. Amendamentele la clauzele contractuale pot fi

      prezentate si odata cu depunerea ofertei urmând ca autoritatea contractanta sa aplice corespunzator prevederile art. 137alin. (3) lit. (b)

      din H.G. nr. 395/2016 cu moficarile si completarile ulterioare. Daca propunerile sunt dezavantajoase pentru AC aceasta îsi rezerva dreptul

      de a le respinge informând ofertantul. Daca ofertantul nu renunta la aceste clauze AC va încadra oferta ca neconforma si o va respinge. În

      cazul unor situatii neprevazute autoritatea contractanta poate modifica contractul în baza art 221 din Legea 98/2016. In situatia in care

      ofertantul apeleaza la o asociere cu alti operatori, la terti sustinatori sau la subcontractanti, in afara documentelor solicitate expres la Cap.

      III.1 – Conditii de participare, in cuprinsul ofertei vor fi incluse si Angajament(e)+declaratii tert sustinator /acord asociere declaratie privind

      partile din contract care se subcontracteaza, dupa caz, intocmite in conformitate cu prevederile legale. In temeiul Art. 217 din Legea nr.

      98 /2016 cu modificarile si completarile ulterioare, documentele prezentate de ofertanti au caracter de documente publice. Accesul

      oricarei

      persoane la acestea nu poate fi restrictionat decat in masura in care aceste informatii sunt confidentiale, clasificate sau protejate de un

      drept de proprietate intelectuala. Conform Art. 123 alin. (1) din HG 395 /2016, ofertantii vor indica informatiile prezentate in cadrul

      procedurii ce sunt confidentiale, clasificate sau sunt protejate de un drept de proprietate intelectuala.
