                              Avand in vedere ca autoritatea contractanta va semna acord cadru doar cu operatorii economici situati pe locurile I,II,III, IV si V, dupa caz, modul de departajare a ofertelor cu preturi egale sa va face astfel:

                              1.1 In cazul in care comisia constata ca au fost depuse/introduse in SICAP, mai mult de 2 oferte admisibile cu preturi egale la ofertantii clasati pe locul I, autoritatea contractanta va transmite in SICAP, o solicitare de clarificare referitoare la depunerea unor noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SICAP, caz in care contractul va fi atribuit primilor 5 ofertanti care au pretul cel mai scazut.

                              1.1.1 In cazul pastrarii egalitatii si dupa solicitarea de clarificari referitoare la depunerea unor noi propuneri financiare imbunatatite in SICAP,autoritatea contractanta va mai solicita maxim 2 clarificari in vederea imbunatatirii pretului ofertat. In cazul in care in urma celor 3 solicitari de clarificari privind depunerea unei noi propuneri financiare, solicitarea de reofertare se face pana la departajarea ofertantilor de pe locul I. 1.1.2. Noua propunere financiara se va depune/introduce in SICAP semnata cu semnatura electronica extinsa. Termenele/datele de depunere ale propunerilor financiare se vor comunica in solicitarea transmisa in SICAP de catre autoritatea contractanta.

                              1.2 In cazul in care comisia constata ca au fost depuse in SICAP mai mult de 2 oferte admisibile cu preturi egale la ofertantii clasati pe locul II, modul de departajare a acestora se va face prin solicitarea, in SICAP,a unei noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SICAP, astfel incat ofertantul clasat pe locul I sa nu fie afectat, respectiv noua propunere financiara sa nu fie egala sau mai mica decat oferta clasata pe locul 1.

                              1.2.1 In cazul in care noua propunere financiara imbunatatita depusa in SICAP, ca urmare a solicitarii autoritatii contractante, primite prin intermediul SICAP,va influenta clasamentul locurilor superioare, aceasta nu va fi luata in considerare, pastrandu-se oferta initiala depusa in SICAP, la procedura.

                              1.3 In cazul in care comisia constata ca au fost depuse mai mult de 2 oferte admisibile cu preturi egale la ofertantii clasati pe locul III, modul de departajare a acestora se va face prin solicitarea, in SICAP, a unei noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SICAP, astfel incat ofertantii clasati pe locul I si II sa nu fie afectati, respectiv noua propunere financiara sa nu fie egala sau mai mica decat oferta clasata pe locul II.

                              1.3.1 In cazul in care noua propunere financiara imbunatatita depusa in SICAP,ca urmare a solicitarii autoritatii contractante, primite prin intermediul SICAP, va influenta clasamentul locurilor I si II, aceasta nu va fi luata in considerare, pastrandu-se oferta initiala depusa in SICAP, la procedura.

                              1.4 In cazul in care comisia constata ca au fost depuse mai mult de 2 oferte admisibile cu preturi egale la ofertantii clasati pe locul IV, modul de departajare a acestora se va face prin solicitarea, in SICAP, a unei noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SICAP, astfel incat ofertantii clasati pe locul I, II si III sa nu fie afectati, respectiv noua propunere financiara sa nu fie egala sau mai mica decat oferta clasata pe locul III.

                              1.4.1 In cazul in care noua propunere financiara imbunatatita depusa in SICAP,ca urmare a solicitarii autoritatii contractante, primite prin intermediul SICAP, va influenta clasamentul locurilor I, II si III, aceasta nu va fi luata in considerare, pastrandu-se oferta initiala depusa in SICAP, la procedura.

                              1.5 In cazul in care comisia constata ca au fost depuse mai mult de 2 oferte admisibile cu preturi egale la ofertantii clasati pe locul V, modul de departajare a acestora se va face prin solicitarea, in SICAP, a unei noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SICAP, astfel incat ofertantii clasati pe locul I, II, III si IV sa nu fie afectati, respectiv noua propunere financiara sa nu fie egala sau mai mica decat oferta clasata pe locul IV.

                              1.5.1 In cazul in care noua propunere financiara imbunatatita depusa in SICAP,ca urmare a solicitarii autoritatii contractante, primite prin intermediul SICAP, va influenta clasamentul locurilor I, II, III si IV, aceasta nu va fi luata in considerare, pastrandu-se oferta initiala depusa in SICAP, la procedura.

                              Castigatorul va fi desemnat prin aplicarea criteriului pretul cel mai scazut.

                              Documentele se incarca in SICAP semnate cu semnatura electronica extinsa conform art. 60 alin. (4) din HG nr. 395/2016.

                              Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.
