        Penitenciarul-Spital București Jilava derulează Programul Național de Prevenire și Supraveghere HIV/SIDA pentru întreg sistemul penitenciar, iar până la finalizarea procedurii de atribuire și punerea la dispoziție a acordurilor-cadru centralizate de către Ministerul Sănătății, unitatea noastră derulează propria procedură de atribuire și atribuie contracte subsecvente în baza acordurilor-cadru încheiate de către aceasta. După finalizarea procedurii de atribuire la nivel centralizat, Penitenciarul-Spital București Jilava va atribui contracte subsecvente în baza acordurilor-cadru puse la dispoziție de către Mănisterul Sănătății, pentru loturille adjudecate de către unitatea centralizatoare.

        Autoritatea contractantă va încheia acorduri-cadru pentru furnizarea de medicamente uz uman cu maxim 3 operatori economici, fara reluarea competitiei. Contractele subsecvente aferente acordurilor-cadru vor fi încheiate de regula trimestrial în funcție de creditele bugetare disponibile, iar plata va fi efectuată în cont de Trezorerie prin OP la 60 de zile. Primul contract subsecvent se va încheia doar după expirarea acordurilor-cadru în vigoare sau după consumarea cantităților maxime prevăzute în cadrul acestora, după caz.

        Primul contract subsecvent și următoarele contractele subsecvente se vor incheia avand in vedere art. 118, alin. 1 lit. a) din Lg 98/2016 cu ofertantul câștigător al acordului-cadru.In cazul in care, dupa perioada de valabilitate a ofertei in care ofertantul clasat pe primul loc se afla in imposibilitatea de a incheia un nou contract subsecvent din motive justificate, autoritatea contractanta isi rezerva dreptul de achizitiona de la locul 2, respectiv locul 3 din acordul cadru.

        Produsele sunt împărțite în loturi pe cantități minime și maxime estimate conform bazei de calcul si anexei nr. 1 la strategia de contractare.

        Livrarea produselor din contractele subsecvente se va face numai pe bază de comanda. Comenzile vor fi transmise de autoritatea contractantă, prin fax sau e-mail iar livrarea se va face periodic in intervalul orar stabilit de comun acord .

        Procedura se va finaliza prin semnarea unui acord cadru pentru fiecare lot.

        Acordul cadru pentru fiecare lot in parte va fi incheiat cu toti operatorii economici clasati pe locurile aferente numarului maxim de operatori economici mentionat, respectiv 3.
