        Cerinta 1: Ofertantii/ asociatii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016.

        Modalitatea prin care poate fi demonstrata indeplinirea cerintei:

        a) Ofertantii vor completa cu informatiile aferente situatiei lor fisierul DUAE, publicat de autoritatea contractanta in cadrul Documentatiei de atribuire , dupa care il vor depune in SEAP – semnat cu semnatura electronica;

        b) Documentele justificative care vor proba îndeplinirea celor asumate prin completarea DUAE vor fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri.

        Aceste documente sunt:

        - Certificat de atestare fiscala privind lipsa datoriilor restante referitoare platii impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii.

        - Certificat fiscal privind lipsa datoriilor restante referitoare platii impozitele, taxele locale si alte venituri ale bugetului local eliberat de Primarie (Consiliul Local) la momentul prezentarii.

        - Cazierul judiciar al operatorului economic și al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv

        Cerinta 2: Ofertantii/ asociatii nu trebuie sa se regaseasca în situatiile prevazute la art. 60 din Legea 98/2016. Persoanele cu functie de decizie din cadrul autoritatii contractante si persoanele cu atributii privind desfasurarea procedurii de atribuire a acordului-cadru sunt urmatoarele :

        Modalitatea prin care poate fi demonstrata indeplinirea cerintei:

        a) Ofertantii vor completa cu informatiile aferente situatiei lor fisierul DUAE, publicat de autoritatea contractanta in cadrul Documentatiei de atribuire, dupa care il vor depune in SEAP – semnat cu semnatura electronica;

        b) Documentele justificative care vor proba îndeplinirea celor asumate prin completarea DUAE vor fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri.

        Aceste documente sunt:- Declaratie conform Art 60 din Legea 98/2016.

        Subcontractantii - In cazul in care ofertantul sau operatorii economici care participa in comun la procedura de atribuire subcontracteaza o parte din contractul de achizitie publica care urmeaza sa fie atribuit, subcontractantul nominalizat va trebui sa detina autorizatiile solicitate prin documentatia de atribuire, cu conditia ca acesta sa execute partea din contract pentru care este solicitata autorizatia respectiva.

        Cerinta 1: Operatorul economic ce depune ofertă trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, este legal constituit si nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitătile care fac obiectul contractului.

        Modalitatea prin care poate fi demonstrata indeplinirea cerintei:

        a) Ofertantii vor completa cu informatiile aferente situatiei lor fisierul DUAE, publicat de autoritatea contractanta in cadrul Documentatiei de atribuire, dupa care il vor depune in SEAP – semnat cu semnatura electronica;

        b) Documentele justificative care vor proba îndeplinirea celor asumate prin completarea DUAE vor fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri.

        Aceste documente sunt:

        - Certificatul constatator emis de Oficiul National al Registrului Comertului - scanat in format .pdf si semnat electronic;

        Nota: In cazul ofertantilor straini, se vor prezenta documente echivalente eliberate de autoritati competente din tara de resedinta - semnat electronic;

        Cerinta 2: Operatorii economici ce depun oferta trebuie sa detina atestare sau apartenenta din punct de vedere profesional, respectiv sa detina Avizul de functionare emis de Ministerul Sanatatii in conformitate cu prevederile H G nr. 144/2010 privind organizarea si functionarea Ministerului Sanatatii Publice, completand in acest sens DUAE. DUAE se va depune, dupa caz, de catre tertul sustinator si de subcontractant, urmand ca Avizul de functionare (sau pentru ofertantii straini, document echivalent emis in tara de rezidenta) sa fie prezentat de ofertantii clasati pe primele 3 locuri, la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor, conform art. 926 alin 2 si 3 din Legea 95/2006, cu modificarile si completarile ulterioare.

        Nota: Fiecare document va fi semnat de reprezentantul legal al ofertantului. In cazul in care acestea sunt semnate de alta persoana, aceasta va prezenta o imputernicire.

        Documentele emise in alta limba decat romana vor fi insotite de traducerea autorizata in limba romana.

        Toate documentele vor avea pe langa semnatura, mentionat in clar numele, prenumele si functia semnatarului.

        Toate documentele se vor depune in SEAP semnate cu semnatura electronica, conform art.60 alin (4) din HG NR.395/2016.
