                                                    1. Modul de departajare a ofertelor cu prețuri egale (în conformitate cu prevederile h295/2016 art. 138, alin. 1, 2 și 3)

                                                    PENTRU FIECARE LOT ÎN PARTE:

                                                    a) În cazul în care au fost depuse oferte admisibile cu prețuri unitare egale la ofertanții clasați pe locul 1, autoritatea contractantă va solicita o propunere financiară îmbunătățită prin intermediul SEAP.

                                                    b) În cazul în care au fost depuse oferte admisibile cu prețuri unitare egale la ofertanții clasați pe locul 2, autoritatea contractantă va solicita o propunere financiară îmbunătățită prin intermediul SEAP, care va fi obligatoriu mai mare decât prețul ofertat pentru locul 1.

                                                    c) În cazul în care au fost depuse oferte admisibile cu prețuri unitare egale la ofertanții clasați pe locul 3, autoritatea contractantă va solicita o propunere financiară îmbunătățită prin intermediul SEAP, care va fi obligatoriu mai mare decât prețul ofertat pentru locul 2.

                                                    d) Clasamentul se va stabili în funcție de prețurile finale ofertate.

                                                    e) Netransmiterea unui preț îmbunătățit (menținerea prețului) va fi considerata ca "solicitare la care nu s-a răspuns", iar oferta va fi considerata ca inacceptabilă în conformitate cu art. 134 alin. 5 din h295/2016;

                                                    2. Cerințele tehnice definite la nivelul anunțului de participare, caietului de sarcini sau altor documente complementare prin trimiterea standardelor la un anumit producător, la mărci, brevete, tipuri, la o origine sau la o producție/metodă specifică de fabricație/prestare/execuție vor fi înțelese ca fiind însoțite de mențiunea ”sau echivalent”.
