    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        Operatorii economici (ofertantii) nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016, cu completarile si modificarile ulterioare.

        Pentru demonstrarea indeplinirii criteriilor/cerintelor de calificare se vor prezenta:

        I. Ofertantii trebuie sa demonstreze ca nu se incadreaza in prevederile art. 164 alin. (1) din Legea nr. 98/2016. In acest sens, Ofertantii vor completa DUAE – Partea III "Motive de excludere" – Sectiunea A "Motive referitoare la condamnarile penale".

        II. Ofertantii trebuie sa demonstreze ca nu se incadreaza in prevederile art. 165 din Legea nr. 98/2016, cu completarile ulterioare.

        In acest sens, Ofertantii vor completa DUAE – Partea III "Motive de excludere" – Sectiunea B "Motive legate de plata impozitelor sau a contributiilor la asigurarilor sociale".

        III. Ofertantii trebuie sa demonstreze ca nu se incadreaza in prevederile art. 167 din Legea nr. 98/2016, cu completarile si mofificarile ulterioare. In acest sens, Ofertantii vor completa DUAE - Partea III "Motive de excludere" - Sectiunea C "Motive legate de insolventa, conflicte de interese sau abateri profesionale".

        IV. Operatorii economici participanti trebuie sa se regaseasca în situatiile prevazute la art.58-63 din Legea 98/2016 .

        I. Modalitatea de indeplinire: Inainte de atribuirea acordului cadru, autoritatea contractanta va solicita ofertantilor clasati pe primele trei locuri dupa aplicarea criteriului de atribuire, sa prezinte documente justificative actualizate la momentul prezentarii prin care sa demonstreze indeplinirea tuturor criteriilor de calificare si selectie, in conformitate cu informatiile cuprinse in DUAE, pentru Ofertantii declarati in oferta.

        Aceste documente pot fi:

        -certificate constatatoare privind plata impozitelor, taxelor, sau a contributiilor la bugetul general consolidat (buget local, buget de stat) valabile la momentul prezentarii, pentru sediul principal, iar pentru sediile secundare/punctele de lucru, o declaratie pe propria raspundere perivind indeplinirea obligatiilor de plata a impozitelor, taxelor, taxelor sau contributiilor la bugetul general consolidat datorate;

        - Cazierul judiciar al operatorului economic şi al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, aşa cum rezultă din certificatul constatator emis de ONRC / actul constitutive, valabile la momentul prezentarii.

        -După caz, documente prin care se demonstreaza faptul că operatorul economic poate beneficia de derogările prevăzute la art.166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achiziţiile publice, valabile la momentul prezentarii.

        -Alte documente edificatoare, dupa caz.

        II. Modalitatea de indeplinire: Inainte de atribuirea acordului cadru, autoritatea contractanta va solicita ofertantilor clasati pe primele trei locuri dupa aplicarea criteriului de atribuire, sa prezinte documente justificative actualizate valabile la momentul prezentarii prin care sa demonstreze indeplinirea tuturor criteriilor de calificare si selectie, in conformitate cu informatiile cuprinse in DUAE, ofertantul declarat in oferta:

        A. Persoanele juridice române trebuie sa prezinte Certificat de atestare fiscala privind îndeplinirea obligatiilor de plata a impozitelor si taxelor sau a contributiilor la bugetul general consolidat, din care sa reiasa lipsa datoriilor restante la momentul prezentarii acestuia. Documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice, daca este cazul.

        B. Persoanele juridice straine vor prezenta documente edificatoare eliberate de institutiile autorizate ale tarii de origine (certificate de atestare fiscala, caziere judiciare, alte documente echivalente, etc.), prin care sa dovedeasca faptul ca si-a indeplinit obligatiile de plata a impozitelor, taxelor sau a contributiilor la bugetul general consolidat, in conformitate cu legislatia nationala a tarii de rezidenta a Ofertantului sau a tarii in care Ofertantul este stabilit. Din documentele edificatoare prezentate trebuie sa reiasa lipsa datoriilor restante la momentul prezentarii acestora. Documentele edificatoare vor fi însotite de traducerea autorizata in limba romana si vor fi valabile la momentul prezentarii.

        III.Modalitatea de indeplinire:

        • Ofertantii vor prezenta o Declaratie cu privire la conflictul de interese in conformitate cu prevederile art. 60 din Legea nr. 98/2016 privind achizitiile publice, cu completarile si modificarile ulterioare. Se va completa Formularul nr. 3 din Sectiunea „Formulare" din Documentatia de Atribuire, stampilat si semnat de catre reprezentantul legal/imputernicit al ofertantului si se va prezenta de catre Ofertant .

        • Inainte de atribuirea acordului cadru, autoritatea contractanta va solicita ofertantilor clasati pe primele trei locuri dupa aplicarea criteriului de atribuire, sa prezinte documente justificative actualizate prin care sa demonstreze indeplinirea tuturor criteriilor de calificare si selectie, in conformitate cu informatiile cuprinse in DUAE, pentru Ofertantul declarat in oferta:

        - certificate, caziere, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), 167 alin. (2), art. 171 din Legea nr. 98/2016 privind achizitiile publice, cu completarile ulterioare,

        -alte documente edificatoare dupa caz.

        IV. Persoanele ce detin functii de decizie din cadrul Autoritatii contractante, precum si persoanele din cadrul Autoritatii contractante ce pot influenta continutul documentatiei de atribuire si/sau desfasurarea procedurii de atribuire sunt:

        Cerinta nr.1

        Certificatul Constatator emis de Oficiul Registrului Comertului de pe langa Tribunalul Teritorial, din care sa rezulte ca activitatea principala/secundara pe care o desfasoara conform codificarii CAEN corespunde obiectului contractului. De asemenea, in Certificatul Constatator emis de Oficiul Registrului Comertului de pe langa Tribunalul Teritorial trebuie sa se regaseasca si urmatoarele informatii: datele de identificare ale operatorului economic, actionarii/asociatii, organele de conducere, administratorii, membrii Consiliului de Administratie, membrii Consiliului de Supraveghere, cotele de participare. Informatiile cuprinse in Certificatul constatator trebuie sa fie reale/actuale la data prezentarii certificatului respectiv.

        II. "Pentru contractele de livrari produse: operatorul economic are nevoie de Avizul de funcționare și anexă, eliberat de Ministerul Sănătății pentru activitatea de comercializare, distribuție din care să rezulte producătorul (pentru produsul oferit) pentru care unitatea avizată (operatorul economic participant la procedura de achiziție publică) este distribuitor, valabil la data prezentării- original / copie legalizată / copie lizibilă cu mențiunea „conform cu originalul”. Actul normativ care impune obligativitatea acestei avizări: Legea nr. 95/2006 privind reforma în domeniul sănătății - Titlul XIX - privind dispozitivele medicale, republicată- Art. 888; O.M.S. 309/2015 – Norme metodologice de avizare a activității în domeniul dispozitivelor medicale- Art. 3, sau în cazul ofertanților străini, documente echivalente emise în țara de rezidență. Precizăm că aceste documente urmează să fie prezentate, la solicitarea autorității contractante doar de catre ofertantii clasati pe primele 3 locuri.

        I Modalitatea de indeplinire

        Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire a contractului de achizitie publica cu informatiile solicitate de catre autoritate autoritate contractanta- informatii referitoare la indeplinirea cerintelor privind capacitatea de exercitare a activitatii profesionale. Documentele justificative care probează îndeplinirea celor asumate prin completarea formularului DUAE, respectiv certificat constatator emis de ONRC, sau în cazul ofertanților străini, documente echivalente emise în țara de rezidență, urmează să fie prezentate, la solicitarea autorității contractante, doar de ofertantii clasati pe primele 3 locuri în clasamentul final întocmit la finalizarea evaluării ofertelor.

        Nota 1: Operatorii economici ce depun oferta, trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Documentele edificatoare vor fi însotite de traducerea autorizata in limba romana.

        II. Modalitatea prin care poate fi demonstrată îndeplinirea cerinței: se va completa formularul DUAE. Documentele justificative care probează îndeplinirea celor asumate prin completarea formularului DUAE sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta urmează a fi prezentate, la solicitarea autorității contractante, de catre ofertantii clasati pe primele 3 locuri, dupa finalizarea evaluarii ofertelor.

      Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.Toate documentele depuse in SEAP, atat de catre autoritatea contractanta, cat si de catre operatorii economici (documentatii, solicitari / raspunsuri de / la clarificari, intrebari, etc.) vor fi incarcate sub forma de fisiere semnate electronic cu semnatura electronica extinsa (conform definitiei date in Legea 455 / 2001 privind semnatura electronica), bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat conform legislatiei in vigoare. Ofertantul are obligatia depunerii DUAE odata cu oferta, sub sanctiunea respingerii acesteia din urma ca inacceptabila conform art. 137 alin (2) lit. b) din H.G. 395 / 2016. Operatorul va prezenta impreuna cu oferta si o imputernicire pentru semnatarul documentelor ofertei. Documentele emise in alta limba decat romana trebuie sa fie insotite de traducerea autorizata in limba romana. Atentie, nu se folosesc prescurtari! Operatorii economici nerezidenti in Romania vor prezenta o declaratie pe propria raspundere semnata de reprezentantul imputernicit sa semneze oferta in care vor fi mentionate perioadele de valabilitate pentru documentele / certificatele emise de autoritatile competente.Avand in vedere ca se încheie un acord cadru cu un numar maxim de 3 operatori economici, criteriul de atribuire fiind pretul cel mai scazut, modalitatea de departajare a eventualelor oferte cu preturi egale va fi reofertarea, autoritatea contractanta urmand sa solicite operatorilor economici in cauza sa incarce electronic prin intermediul SEAP documente care contin noile preturi.
