        Ofertantii, tertii sustinatori, subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016”

        Certificatul de atestare fiscala din care sa reiasa lipsa datoriilor restante, cu privire la plata contributiilor la bugetul general consolidat, la momentul prezentarii acestora; c)Certificatul de atestare fiscala din care sa reiasa lipsa datoriilor restante, cu privire la plata impozitelor si taxelor la bugetul local, la momentul prezentarii acestora. Se vor prezenta Certificatele de atestare fiscala privind indeplinirea obligatiilor de plata a impozitelor, taxelor si contributiilor de asigurari sociale la toate sediile si punctele de lucru pentru care exista obligatii de plata;” intrucat, in conformitate cu prevederile art.165 alin.(2) din Legea nr.98/2016, operatorul economic nu este exclus din procedura de atribuire dacă, anterior deciziei de excludere, îşi îndeplineşte obligaţiile prin plata impozitelor, taxelor sau contribuţiilor la bugetul general consolidat datorate ori prin alte modalităţi de stingere a acestora sau beneficiază, în condiţiile legii, de eşalonarea acestora ori de alte facilităţi în vederea plăţii acestora, inclusiv, după caz, a eventualelor dobânzi ori penalităţi de întârziere acumulate sau a amenzilor. Pentru claritate si transparenta completati astfel: “certificate constatatoare privind plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) valabile la momentul prezentarii, pentru sediul principal, iar pentru sediile secundare/punctele de lucru, se va prezenta o declaraţie pe propria răspundere. potrivit art.165 alin. (3) din legea nr.98/2016, cu modificarile si completarile ulterioare. Observatie calitate. In drept: Art. 165 din Legea nr. 98/2016.

        c)Persoanele cu functii de decizie din cadrul autoritatii contractante în ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire sunt: Manager- dr.         Ofertantul trebuie sa faca dovada ca în ultimii 3 ani de la data limita stabilita pentru depunerea ofertelor a executat acest tip de contract la nivelul unui contract sau mai multe contracte, de natura si complexitate similara/comparabila sau superioara cu vanzarile care fac obiectul contractului.

        Pentru echivalarea experientei similare declarata în alta moneda decât leul si euro, se va utiliza cursul mediu anual leu/valuta, comunicat de BNR.

        Ultimii 3 ani se raporteaza la termenul limita de depunere a ofertelor. In cazul in care se decaleaza termenul limita de depunere a ofertelor (fiind publicata o erata in acest sens), limita inferioara a perioada de 3 ani se extinde cu perioada de timp aferenta decalarii.
