        Cerinta nr. 4 - Indeplinirea obligatiilor exigibile de plata la bugetul consolidat al statului. Operatorul economic(lider, asociat, tert sustinator, subcontactant, daca este cazul) va completa cerinta corespunzatoare in formularul DUAE din documentatia de atribuire.

        Pentru confirmarea celor declarate in DUAE se va solicita ofertantului clasat pe locul I, dupa aplicarea criteriului de atribuire(inclusiv de catre ofertantul asociat al castigatorului licitatiei sau tertul sustinator, dupa caz) prezentarea , pana la data incheierii raportului

        procedurii de atribuire, a urmatoarelor documente:

        - Certificat de atestare fiscala pentru persoane juridice privind obligatiile de plata la bugetul consolidat al statului in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul, document din care sa reiasa ca ofertantul nu are datorii

        restante la momentul in care trebuie sa prezinte acest certificat. In acest caz sun aplicabile prevederile art. 166 (2) din Legea nr. 98/2016 privind achizitiile publice;

        - Certificat de atestare fiscala pentru persoane juridice privind obligatiile de plata la bugetul local in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul, document din care sa reiasa ca ofertantul nu are datorii restante la momentul

        in care trebuie sa prezinte acest certificat. In acest caz sunt aplicabile prevederile art. 166 (2) din Legea nr. 98/2016 privind achizitiile publice

        -Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau supraveghere al respectivului operator economic sau a celor ce au putere de decizie sau de control in cadrul acestuia asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv

        - Documente, dupa caz, prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art.166 alin. (2),art.167 alin.(2), art.171 din Legea 98/2016, sau orice alte documente edificatoare.

        - Pentru persoane juridice straine: Operatorul economic va prezenta documente edificatoare – eliberate de autoritati ale tarii de origine (certificate, caziere judiciare, alte documente echivalente) pentru a rezulta apartenenta / înregistrarea la organe din tara respectiva.

        - Se vor prezenta certificate/documente suport conform prevederilor legale, care sa ateste ca acestia nu inregistreaza obligatii fiscale restante in conditiile legii incidente in tara de rezidenta.

        - Documentele prezentate in alta limba decat cea romana vor fi insotite OBLIGATORIU de traducere autorizata.

        Pentru persoanele juridice straine ca modalitate de indeplinire a cerintei este si completarea DUAE conform art.193 din Legea 98/2016, urmand ca documentele edificatoare sa fie prezentate doar la solicitarea autoritatii contractante, si doar ofertantului clasat pe locul I, la finalizarea evaluarii ofertelor.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, ca sunt legal constituiti, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici(lider, asociat, tert sustinator, subcontractant, daca este cazul) participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentul justificativ care probeaza indeplinirea celor asumate prin completarea DUAE este Certificatul Constatator emis de ONRC sau, in cazul ofertantilor straini, documente echivalente, emise de catre tara de rezidenta. Inainte de atribuirea Acordului – cadru, autoritatea contractanta va solicita ofertantilor(lider, asociat, tert sustinator subcontractant, daca este cazul,) clasati pe locul I, dupa aplicarea criteriului de atribuire sa prezinte documente justificative in original sau copie certificata cu originalul, pe propria raspundere, prin care sa demonstreze indeplinirea criteriilor de calificare, in conformitate cu informatiile cuprinse in DUAE.

        Pentru persoane juridice straine, documentele prezentate in alta limba decat cea romana, vor fi insotite OBLIGATORIU de traducerea autorizata.

        Pentru operatorii economici straini modul de indeplinire se va realiza prin prezentarea de documente echivalente emise in conformitate cu legislatia din tara de rezidenta.

        Documentele se vor semna cu semnatura electronica extinsa si se vor posta in SICAP.

În cazul în care autoritatea contractantă este nevoită să procedeze la decalarea termenului limită stabilit pentru depunerea ofertelor, publicând în acest sens o erată, limita inferioară a perioadei de 3 ani se extinde cu perioada de timp aferentă decalării, urmând a fi considerată îndeplinită cerinţa pentru toţi operatorii care au prezentat dovada finalizării contractului de experienţă similară în intervalul de timp nou rezultat. Ultimii 3 ani se raporteaza la termenul limita de depunere a ofertelor, cu aplicarea corespunzatoare a Instructiunii ANAP nr. 2/2017 (art. 13).Pentru conversia in RON, daca situatiile sunt intocmite in alta moneda, se va lua in considerare cursul mediu anual de referinta publicat de BNR pentru anul respectiv. Informatii privind sustinerea capacitatii tehnice si/sau profesionale - in conformitate cu Legea 98/2016 privind achizitiile publice cu modificarile si completarile ulterioare.

        Ofertantii (inclusiv asociati, tert sustinator) vor completa DUAE cu informațiile ce descriu nivelul lor de experiență, corespunzător cerințelor autorității contractante.Se va menționa în DUAE dacă valoarea raportată include TVA sau nu include TVA. La nivelul DUAE, trebuie precizate urmatoarele informații: numărul și data contractului invocat/e drept experiență similară, valoarea, beneficiarul, ponderea și/sau activitățile pentru care a fost responsabil, certificări/ procese verbale de recepție/ de acceptanta/ depunere in functiune/ contracte/ parti din contracte / alte documente ce indică valorile, datele și beneficiarii sistemelor/ produselor livrate emise sau contrasemnate de catre o autoritate sau de catre clientul beneficiar. Lista se va completa la nivelul DUAE si nu ca document distinct, urmand ca documentele justificative sa fie prezentate doar de catre ofertantul clasat pe locul intai in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, la solicitarea autoritatii contractante.Documentele justificative pot fi reprezentate de (dar fara a se limita la acestea):- procesul-verbal de recepție/acceptanta/punere in functiune sau alte documente din care să reiasă următoarele informații - beneficiarul, cantitatea/ valoarea, perioada și locul livrării;- recomandări; - alte documente echivalente.
