Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Atendendo ao previsto no n.º 1 do artigo 370.º do CCP, na sua redação atual dada pelo Decreto-Lei n.º 78/2022, de 7 de novembro, estamos perante trabalhos complementares por se tratarem de trabalhos cuja espécie ou quantidade não esteja prevista no contrato e cuja realização se revele necessária para a sua execução.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Entende-se que o Dono da Obra pode ordenar a execução destes trabalhos complementares ao empreiteiro uma vez que a mudança do cocontratante não é viável por razões técnicas, designadamente em função da necessidade de assegurar a permutabilidade ou interoperabilidade com equipamentos, serviços ou instalações existentes, e é altamente inconveniente porque tal implicaria uma alteração no prazo da obra e subsequente acréscimo de custos para o Dono da Obra.
