              1. Środki ochrony prawnej przewidziane w Dziale IX Ustawy Pzp przysługują Wykonawcy, a także innemu podmiotowi, jeżeli ma lub miał interes w uzyskaniu danego zamówienia oraz poniósł lub może ponieść szkodę w wyniku naruszenia przez Zamawiającego przepisów Ustawy.

              2. Środki ochrony prawnej wobec ogłoszenia o zamówieniu oraz specyfikacji warunków zamówienia przysługują również organizacjom wpisanym na listę organizacji uprawnionych do wnoszenia środków ochrony prawnej prowadzoną i ogłaszaną przez Prezesa Urzędu Zamówień Publicznych, o której mowa w art. 469 pkt. 15 ustawy oraz Rzecznikowi Małych i Średnich Przedsiębiorców.

              3. Odwołanie przysługuje wyłącznie od niezgodnej z przepisami ustawy czynności zamawiającego podjętej w postępowaniu o udzielenie zamówienia lub zaniechania czynności, do której zamawiający jest zobowiązany na podstawie ustawy.

              4. Szczegółowe zasady wnoszenia środków ochrony prawnej oraz postępowania toczonego wskutek ich wniesienia określa Dział IX ustawy PZP.
