    1. Przedmiotem zamówienia jest dostawa wyrobów medycznych używanych w zakładzie radiologii zabiegowej w asortymencie oraz wymaganiach określonych w załączniku nr 3 do SWZ.
    
    2. Zamawiający wymaga, aby zaoferowany asortyment stanowiący wyrób medyczny spełniał wymagania dotyczące wyrobów medycznych zawarte w Ustawie z dnia 7 kwietnia 2022 roku o wyrobach medycznych (t.j. Dz. U. z 2022, poz. 974 z późn. zm.) oraz w wydanych na podstawie tejże ustawy aktach wykonawczych.
    
    3. Wyroby medyczne muszą spełniać wymagania określone w załączniku nr 3 do SWZ. Niespełnienie chociażby jednego z wymagań określonych w załączniku nr 3 do SWZ spowoduje odrzucenie oferty.
    
    4. Wyroby medyczne, o których mowa w ust. 1 Wykonawca zobowiązany będzie dostarczyć na własny koszt do Działu Zaopatrzenia Medycznego, ul. Smoluchowskiego 17.

        4. Zamawiający dopuszcza zmianę umowy zgodnie z załącznikiem 4a oraz 4b do SWZ.
        
        5. W przypadku gdy wartości podane przez Wykonawców na oświadczeniach i dokumentach, o których mowa w ust. IX pkt 7 SWZ, podane będą w walucie innej niż PLN, Zamawiający przeliczy te wartości na PLN przyjmując średni kurs NBP danej waluty na dzień wszczęcia postępowania.
        
        6. Wszelkie nieuregulowane w niniejszym SWZ czynności, uprawnienia, obowiązki Wykonawców i Zamawiającego, których ustawa nie nakazała zawierać Zamawiającemu w SWZ, a które mogą przyczynić się do właściwego przebiegu postępowania, reguluje ustawa PZP.
        
        7. Zamawiający przewiduje dokonanie zmian umowy w toku jej realizacji w przypadku zaistnienia okoliczności, o których mowa w art. 455 ustawy PZP.
        
        8. Warunkiem udziału w postępowaniu o udzielenie zamówienia jest wniesienie wadium w prawidłowej wysokości dla danej części, na którą Wykonawca składa ofertę, szczegółowe informację zawarte w ust. XXII SWZ
        
        9. Klauzula informacyjna dotycząca Rozporządzenia o Ochronie Danych Osobowych (RODO) , szczegółowe informację zawarte w ust. XXVI SWZ
