    W celu spełniania ww. warunku Wykonawca zobowiązany jest wykazać, że posiada:
    
    a) uprawnienia do prowadzenia hurtowni farmaceutycznej,
    
    b) w zakresie pakietu nr 7, nr 8, nr 9 – uprawnienia do obrotu produktami leczniczymi zawierającymi w swoim składzie środki odurzające, substancje psychotropowe lub prekursory kategorii 1.
    
    Uwaga: W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia ww. warunki zostaną uznane za spełnione, jeśli co najmniej jeden z Wykonawców składający ofertę wspólną, posiada ww. uprawnienia (tj. w zakresie prowadzenia hurtowni farmaceutycznej/obrotu produktami leczniczymi zawierającymi w swoim składzie środki odurzające, substancje psychotropowe lub prekursoty kategorii 1(w zakresie pakietów wymienionych w lit. b) i zrealizuje dostawy, do których te uprawnienia są wymagane.
    
    W celu tymczasowego potwierdzenia (zastępującego) wymagane przez Zamawiającego podmiotowe środki dowodowe, których Zamawiający zażąda od Wykonawcy, którego oferta została najwyżej oceniona), spełniania warunku posiadania uprawnienia do prowadzenia określonej działalności gospodarczej lub zawodowej wykonawca składa wraz z ofertą aktualne na dzień składania ofert oświadczenie na formularzu Jednolitego Europejskiego Dokumentu Zamówienia (JEDZ) - załącznik nr 2 do SWZ.
    
    Zgodnie z art. 126 ust 1 ustawy Pzp Zamawiający wezwie wykonawcę, którego oferta została najwyżej oceniona, do złożenia w wyznaczonym terminie, nie krótszym niż 10 dni od dnia wezwania, podmiotowych środków dowodowych, aktualnych na dzień złożenia podmiotowych środków dowodowych, tj.: potwierdzających, że wykonawca posiada uprawnienia do prowadzenia hurtowni farmaceutycznej,
    
    W celu wykazania tego obowiązany jest złożyć następujący dokument:
    
    a) aktualną koncesję na prowadzenie hurtowni farmaceutycznej wydaną na podstawie wcześniej obowiązujących przepisów tj. ustawy z dnia 10 października 1991 r. o środkach farmaceutycznych, materiałach medycznych, aptekach, hurtowniach i Inspekcji Farmaceutycznej (Dz. U. 1991 r. nr 105 poz. 452) lub posiada aktualne zezwolenie na prowadzenie hurtowni farmaceutycznej zgodnie z ustawą z dnia 6 września 2001 roku Prawo farmaceutyczne (Dz. U. z 2022 r. poz. 2301 t.j.) w przypadku artykułów, do których w/w dokument jest wymagany przepisami prawa (natomiast w przypadku produktów, do których nie jest wymagany przepisami prawa ww. dokument Wykonawca złoży stosowne oświadczenie potwierdzające ten fakt).
    
    oraz
    
    b) w zakresie pakietu nr 7, nr 8, nr 9 - pozwolenie na obrót produktami zgodnie z przepisami prawa – w przypadku produktów leczniczych zawierających w swoim składzie środki odurzające, substancje psychotropowe lub prekursory kategorii 1.
    
    Ww. dokument należy złożyć w oryginale w postaci dokumentu elektronicznego lub w elektronicznej kopii dokumentu poświadczonej za zgodność z oryginałem.

    W celu spełniania ww. warunku Wykonawca zobowiązany jest wykazać, że jest ubezpieczony od odpowiedzialności cywilnej w zakresie prowadzonej działalności związanej z przedmiotem zamówienia na sumę ubezpieczenia - dla każdego pakietu - nie niższą niż określona w SWZ (Rozdział VI, dział II pkt 2).
    
    Uwaga: W przypadku, gdy wykonawca ubiega się o udzielenie zamówienia w kilku pakietach to ubezpieczenie musi obejmować łączną sumę ubezpieczenia dot. tych pakietów, w których wykonawca będzie składał ofertę.
    
    W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia ww. warunek w ramach pakietu musi spełniać: jeden wykonawca w całości.
    
    W celu tymczasowego potwierdzenia (zastępującego) wymagane przez Zamawiającego podmiotowe środki dowodowe, których Zamawiający zażąda od Wykonawcy, którego oferta została najwyżej oceniona), spełniania warunku dotyczącego sytuacji ekonomicznej lub finansowej wykonawca składa wraz z ofertą aktualne na dzień składania ofert oświadczenie na formularzu Jednolitego Europejskiego Dokumentu Zamówienia (JEDZ) - załącznik nr 2 do SWZ

    Ww. dokument należy złożyć w oryginale w postaci dokumentu elektronicznego lub w elektronicznej kopii dokumentu poświadczonej za zgodność z oryginałem.
    
    Uwaga: Jeżeli z uzasadnionej przyczyny wykonawca nie może złożyć wymaganych przez zamawiającego podmiotowych środków dowodowych, o których mowa w lit. c wykonawca składa inne podmiotowe środki dowodowe, które w wystarczający sposób potwierdzają spełnianie opisanego przez zamawiającego warunku udziału w postępowaniu lub kryterium selekcji dotyczącego sytuacji ekonomicznej lub finansowej.

W niniejszym postępowaniu zastosowanie znajduje art. 139 ustawy Pzp. Oznacza to, że Zamawiający najpierw dokona badania i oceny ofert, a następnie dokona kwalifikacji podmiotowej wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu.

8. Komunikacja między Zamawiającym a Wykonawcami, w tym oferty oraz wszelkie oświadczenia, wnioski(w tym o wyjaśnienie treści SWZ, zawiadomienia i informacje przekazywane są wyłącznie w formie elektronicznej za pośrednictwem platformy portal SmartPZP (zwanej dalej: „Platformą”) pod adresem:https://portal.smartpzp.pl/spszozzdroje;

9. Zamawiający przewiduje możliwość zmiany umowy w przypadkach określonych w SWZ (rozdział XIV –wzory umów)

Przedmiotem zamówienia jest zawarcie umowy ramowej

1) ze względu na specyfikę przedmiotu zamówienia umowa ramowa w danym pakiecie (zadaniu) zostanie zawarta z jednym wykonawcą.

2) Zamawiający – zgodnie z art. 313 ust 1 ustawy Pzp – każdorazowo udzieli zamówienia Wykonawcy na warunkach zamówienia określonych w umowie ramowej, bez przeprowadzania postępowania o udzielenie zamówieni;

3) w trakcie realizacji umowy ramowej na podstawie, której wykonawcy będzie udzielane każdorazowo zamówienie na warunkach zamówienia określonych w niniejszej umowie Zamawiający zastrzega sobie prawo do korygowania (zmiany) asortymentu i ilości przedmiotu zamówienia na inny wymieniony w załączniku „Szczegółowa oferta cenowa”.
