         Wykonawca biorący udział w Postępowaniu musi wykazać, że posiada koncesję na obrót olejem napędowym zgodnie z ustawą z dnia 10 kwietnia 1997 r. Prawo energetyczne (Dz.U. 2022 poz. 1385 z późn. zm. zm.) oraz Rozporządzeniem Ministra Aktywów Państwowych z dnia 27 listopada 2019 r. w sprawie szczegółowego wykazu paliw ciekłych, których wytwarzanie, magazynowanie lub przeładunek, przesyłanie lub dystrybucja, obrót, w tym obrót z zagranicą, wymaga koncesji oraz których przywóz wymaga wpisu do rejestru podmiotów przywożących (Dz.U. 2021 poz. 2336), ważną na dzień jej złożenia.
