        1. Każdemu Wykonawcy, a także innemu podmiotowi, jeżeli ma lub miał interes w uzyskaniu danego zamówienia oraz poniósł lub może ponieść szkodę w wyniku naruszenia przez Zamawiającego przepisów ustawy Pzp przysługują środki ochrony prawnej przewidziane w dziale IX niniejszej ustawy.
        
        2. Środki ochrony prawnej wnosi się na zasadach określonych w art. 513-516 ustawy Pzp.
        
        3. Termin wniesienia odwołania określa art. 515 ustawy Prawo zamówień publicznych.
        
        4. Środki ochrony prawnej wobec ogłoszenia o zamówieniu oraz dokumentów zamówienia przysługują również organizacjom wpisanym na listę, o której mowa w art. 469 pkt. 15 ustawy Pzp, oraz Rzecznikowi Małych i Średnich Przedsiębiorców.
