      Przesłanką skrócenia terminu składania ofert jest pilna potrzeba udzielenia zamówienia. Skrócenie terminu składania ofert jest uzasadnione. Wiąże się z koniecznością szybkiego działania ze strony zamawiającego w celu zabezpieczenia potrzeb szpitala wraz z upływem terminu aktualnie obowiązujących umów. Zamawiający jest podmiotem leczniczym, a dostawy leków programowych użytku są bardzo istotne z punktu widzenia działalności szpitala jaką jest hospitalizacja pacjentów i zachowania ciągłości świadczenia dostaw. Ustalenie ostatecznych warunków dla nowego przetargu wymagało wypracowania określonych rozwiązań, z uwzględnieniem nowych okoliczności. Prace nad opisem przedmiotu zamówienia oraz pozostałych wymagań zamawiającego zakończyły się na etapie, w którym nie jest już możliwe zachowanie podstawowych terminów przewidzianych w ustawie.
