        została najwyżej oceniona/ jakie Zamawiający uzyska za pomocą bezpłatnych i ogólnodostępnych baz danych,
        
        zgodnie z art. 127 ust. 1, w celu potwierdzenia braku podstaw do wykluczenia zgodnie z art. 124 ust. 1) PZP:
        
        1. Informacja z Krajowego Rejestru Karnego w zakresie określonym w art. 108 ust. 1 pkt 1 i 2 PZP sporządzona
        
        nie wcześniej niż 6 miesięcy przed jej złożeniem.
        
        2. Oświadczenie Wykonawcy o aktualności informacji zawartych w oświadczeniu, o którym mowa w art. 125 ust.
        
        1 PZP, w zakresie podstaw wykluczenia z postępowania wskazanych przez Zamawiającego, o których mowa w
        
        art. 108 ust. 1 pkt 3 PZP.
        
        3. Informacja z Krajowego Rejestru Karnego w zakresie określonym w art. 108 ust. 1 pkt 4 PZP, dotycząca
        
        orzeczenia zakazu ubiegania się o zamówienie publiczne tytułem środka karnego sporządzona nie wcześniej
        
        niż 6 miesięcy przed jej złożeniem.
        
        4. Oświadczenie Wykonawcy o aktualności informacji zawartych w oświadczeniu, o którym mowa w art. 125 ust.
        
        1 PZP, w zakresie podstaw wykluczenia z postępowania wskazanych przez Zamawiającego, o których mowa w
        
        art. 108 ust. 1 pkt 4 PZP, dotyczących orzeczenia zakazu ubiegania się o zamówienie publiczne tytułem środka
        
        zapobiegawczego.
        
        5. Oświadczenie Wykonawcy, w zakresie art. 108 ust. 1 pkt 5 PZP, o braku przynależności do tej samej grupy
        
        kapitałowej w rozumieniu ustawy z dnia 16 lutego 2007 r. o ochronie konkurencji i konsumentów (Dz. U. z
        
        2020 r. poz. 1076 i 1086), z innym Wykonawcą, który złożył odrębną ofertę częściową, albo oświadczenie
        
        o przynależności do tej samej grupy kapitałowej wraz z dokumentami lub informacjami potwierdzającymi
        
        przygotowanie oferty częściowej niezależnie od innego Wykonawcy należącego do tej samej grupy kapitałowej.
        
        6. Oświadczenie Wykonawcy o aktualności informacji zawartych w oświadczeniu, o którym mowa w art. 125 ust.
        
        1 PZP, w zakresie podstaw wykluczenia z postępowania wskazanych przez Zamawiającego, o których mowa w
        
        art. 108 ust. 1 pkt 5 PZP, dotyczących zawarcia
        
        z innymi wykonawcami porozumienia mającego na celu zakłócenie konkurencji.
        
        7. Oświadczenie Wykonawcy o aktualności informacji zawartych w oświadczeniu, o którym mowa w art. 125 ust.
        
        1 PZP, w zakresie podstaw wykluczenia z postępowania wskazanych przez Zamawiającego, o których mowa w
        
        art. 108 ust. 1 pkt 6 PZP.
        
        Informacje dotyczące wspólnego ubiegania się Wykonawców o udzielenie zamówienia oraz przypadku,
        
        gdy siedziba lub miejsca zamieszkania Wykonawcy znajdują się poza terytorium Rzeczypospolitej Polskiej
        
        oraz Urzędowego wykazu zatwierdzonych Wykonawców, Wykonawcy certyfikowanego przez jednostki certyfikujące spełniające wymogi
        
        europejskich norm certyfikacji zostały opisane w treści SWZ.
        
        II. 1. Zamawiający wykluczy z postępowania Wykonawców, o których mowa w art. 7 ust. 1 ustawy z dnia 13
        
        kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz
        
        służących ochronie bezpieczeństwa narodowego.
        
        2. Zamawiający stosuje ponadto art. 5k Rozporządzenia Rady (UE) nr 833/2014 z dnia 31 lipca 2014 r.
        
        dotyczącego środków ograniczających w związku z działaniami Rosji destabilizującymi sytuację na Ukrainie
        
        (Dz. Urz. UE nr L 229 z 31.7.2014, str. 1, ze zm.).
        
        Szczegóły określa §17A SWZ.
        
        III. Zamawiający przewiduje zastosowanie procedury o której mowa w art. 139 PZP.

        Środki ochrony prawnej zostały określone w Dziale IX ustawy PZP. Środki ochrony prawnej przysługują Wykonawcy oraz innemu podmiotowi, jeżeli ma lub miał interes w uzyskaniu zamówienia oraz poniósł lub może ponieść szkodę w wyniku naruszenia przez Zamawiającego przepisów ustawy. Środki ochrony prawnej wobec ogłoszenia wszczynającego postępowanie o udzielenie zamówienia oraz dokumentów zamówienia przysługują również organizacjom wpisanym na listę, o której mowa w art. 469 pkt 15 PZP, oraz Rzecznikowi Małych i Średnich Przedsiębiorców. Szczegółowe regulacje w zakresie środków ochrony prawnej zawiera Dział IX ustawy PZP.
