Øygarden Municipality would like to enter into a concession contract with up to 6 tenderers for user-controlled personal assistance (BPA). This means that users that are entitled to BPA can choose a private supplier. There are approx. 20 users in Øygarden Municipality that required BPA.

Øygarden Municipality invites tenderers to apply for a concession for the provision of assistance hours in the user-controlled personal assistance scheme, to users in the municipality. Up to 6 of the best tenderers that fulfil the qualification requirements and minimum requirements will be awarded a concession.

II.2.4)Description of the procurement:

BPA has a legal basis in the Health and Care Services Act dated 24.06.2011, with the accompanying amendments in accordance with the Patient and User Rights Act dated 02.07.1999. It is the administration agency in Øygarden Municipality that is responsible for ensuring that users have their service needs fulfilled with an individual decision in the Health and Care Services Act § 3-8, cf. § 3-2 first paragraph no. 6 letter b, also cf. the Patient and User Rights Act § 2-1 letter d.

There is an estimated need for 825 hours of user-controlled personal assistance every week for the 20 users in 2024.

The concession contracts include full responsibility for the operation and remuneration for the chosen tenderers. This means that will not receive a fixed amount from the contracting authority, and that the contracting authority will not guarantee any minimum volume for the services, as this depends on the users" choice.
