Der ORF beabsichtigt den Abschluss eines neuen auf drei Jahre befristeten Rahmenvertrages mit Adobe System Software Irland Limited (sog Enterprise Term License Agreement, kurz „Adobe ETLA“) über die Wartung und den Bezug von Adobe (Standard-) Produkten. Es handelt sich um Standardlizenzen, die nach einem Mietlizenzmodell bezogen werden.

Explanation:

Die Softwareprodukte von Adobe Systems Ireland Limited (Standardsoftwarepaket; insbesondere Pdf-Dokumentenerstellung als allgemein verbreitete Standard-Software) sind ein bereits integrierter und unverzichtbarer Teil der IT-Infrastruktur des ORF. Adobe Systems Ireland Limited ist Hersteller und Lizenzinhaber. Die gegenständliche Lizenzierung (Wartung iSv Updates und Upgrades; aufgrund der Distributionspolitik des Herstellers zeitlich befristet) direkt beim Hersteller ist erforderlich, um die weitere Nutzung der Software zu ermöglichen. Aufgrund von Ausschließlichkeitsrechten des Herstellers wurde mit diesem daher ein Verhandlungsverfahren ohne vorherige Bekanntmachung (§ 31 Abs 6 iVm § 36 Abs 1 Z 3 BVergG 2018) durchgeführt.
