In connection with the construction of the "Blue Building", Nord University will acquire a zebrafish facility for research and teaching purposes. Statsbygg is the owner and builder of the project. The contract between the builder and the contractor includes essential components for the zebrafish department that are adapted to the equipment required by Nord University.

The procurement includes zebrafish facilities that are compatible with shelving, tanks and racks that Nord University already owns. The procurement, including equipment and installation, has a value of approx. NOK 12,621,325 excluding VAT. The needs that the procurement will cover are described in more detail in the attached requirements specification.

IV.1.1)Type of procedure

Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

The procurement falls outside the scope of application of the directive

Explanation:

Nord University is authorised to enter into a direct procurement with the selected supplier for the delivery of zebrafish facilities, cf. § 13-4, first paragraph, letter b no. 2.

Nord University"s market research has revealed that there are no other suppliers that can offer solutions that are compatible with both the components purchased for the building and the existing equipment. RO loops and reservoir tanks have been purchased from Tecniplast, as well as RO systems from Avidity. Furthermore, Nord University has existing equipment, including 5 racks, aquariums and loose equipment, which are either supplied by Scanbur or are compatible with their solutions.

Nord University has investigated whether tenderers who have previously offered equipment for zebrafish facilities in our contests can offer the relevant equipment. As a result of these companies having discontinued their sales of zebrafish equipment, they will not be able to offer compatible equipment. Nor have any other suppliers been identified that can offer similar solutions or compatible systems. Part of the procurement also consists of a special washing machine for zebrafish equipment that only the selected supplier can deliver.

As the contracting authority has made major investments in the zebrafish facility through the contract, it would not be a reasonable alternative to carry out a gradual replacement of the equipment or to hold a contest in the market without other suppliers having a real opportunity to offer compatible equipment. Furthermore, the contracting authority is not allowed to postpone the procurement while waiting for other suppliers to develop products or equipment that are compatible with existing components, as the installation must be carried out before the building is completed.
