The Central Norway Regional Health Authority, St. Olavs Hospital Trust, represented by the Central Professional Unit for Compulsory Care, and the Lukas Foundation, represented by Betania Malvik, jointly intend to establish a contract for a respite care unit for compulsory care on behalf of the central professional unit at St. Olavs Hospital Trust by using premises, equipment, and personnel, etc., at Betania Malvik for providing such a service. The practice of compulsory care is pursuant to the Criminal Procedure Act § 64 and to separate regulations.

II.2.4)Description of the procurement:
The Central Professional Unit for Compulsory Care (SFTO) at St. Olavs Hospital Trust needs four 24-hour places for persons who are sentenced to compulsory care. The respite care unit must be located outside the hospital and reasonably close the professional unit"s premises (Post F) at Østmarka in Trondheim. The 24-hour places must be established in a separate respite care unit where persons who are sentenced to compulsory care can stay whilst waiting a review/mapping at St. Olavs Hospital Trust post F or a transfer to residential and care measures in the sentence person"s home municipality. The contract covers the following for the provision of the service:
• Premises
• Personnel
• Food and board
• Transport, etc., that is necessary for providing the service

Explanation:
The contract will be signed without a prior notice, cf. the exception in the public procurement regulations § 2-4 h) on the practice of public authority. This is justified as follows:
1) The contract is based on a special reaction that involves the depriving freedom, 2) the power to practice compulsion is transferred through a contract with the public authorities and does not follow the employees" authorisation, etc., and 3) that the level of compulsion is beyond the level that is deemed as sufficiently qualified to practice public authority in other cases.
