Voluntary ex-ante transparency notice - contract for maintenance of the Corporater software
Bergen Municipality intends to enter into a contract with Corporater AS for the maintenance and service of software for the municipality"s iCT system for goal and result management, Corporate.
Bergen Municipality procured the system through a contest in the market. The tenderer has exclusive rights to maintenance and licence expansions. The contract is expiring and there is a need for further maintenance services.
The new maintenance contract will be valid for one year and then renewed for one year at a time up to four times, i.e. a maximum duration of four years.
The contract is estimated to have a value of NOK 1 million a year.
Corporater is the municipality"s management and reporting tool for simple information collection and follow-up of the result units" service production and operation. The system presents service production at service level and municipality level, and is used to compare and measure efficiency and quality. Corporater is used as a strategic planning tool for managers to make guidelines for the long strategy, goal, and resource management lines for each unit.
Services that are included in the framework agreement are:
- Software maintenance that includes access to error corrections, improvements, and upgrades.
- User support.
- Operations support for the municipality"s internal ICT operations supplier for upgrades/error corrections.
A contract will be entered into based on the Norwegian Government"s standard contract for IT procurements, the Maintenance Contract - Contract for maintenance and service of equipment and software. The contract applies to all of Bergen Municipality.
Bergen Municipality plans to hold a contest for a new ICT system for goal and result management. The contract will be cancelled when a new contract is awarded and new service is established.
The contracting authority will not sign a contract for until at least 10 days after this notice has been published on Doffin/TED.

Section IV: Procedure
Corporater is a group-wide system for strategic management and quality follow-up. It is particularly necessary to ensure stable access to the services for fields connected to processing protocols for personal information and risk management. Since the tenderer has exclusive rights to maintenance and licence expansions for the software, it is not possible to bring in other suppliers for this system. The conditions in § 13-4, letter b), alternative 3 "The procurement concerns services that only a specific supplier can provide because the supplier has exclusive rights, including intellectual property rights" are considered to be fulfilled and that there is authorisation to carry out a procurement without a contest. The contract with Corporater is expiring and there is a need for further maintenance and operational support for a limited period while a new tender contest is planned and organised for the delivery of goal and result management in Bergen Municipality. Bergen Municipality will make a decision on a new system through a new contest in the market. Any system change will be very extensive and there is therefore a need to organise a tender contest with sufficient time to plan, implement and establish the service. The contract will be cancelled when a new contract is awarded and new service is established.
