         The Norwegian Hospital Procurement Trust [Sykehusinnkjøp] refers to the tender offer submitted in the contest for Instruments and instrument-specific consumables for rapid tests for diagnostic microbiology for St. Olav’s Hospital Trust.

         The contracting authority has decided to cancel the tender contest, cf. the Public Procurement Regulations of

         12 August 2016 (PPR), Part III, § 25-4, first paragraph. This is because the Contracting Authority considers that the conditions for "justifiable cause" have been met. The justification for the cancellation is ambiguities in the tender documentation.

         Pursuant to § 25-4, second paragraph, of the Public Procurement Regulations, the notice must contain a short justification and, if applicable, information on whether the contracting authority intends to hold a new contest for the same procurement.

         In this case, the Contracting Authority considers that there are ambiguities in the tender documentation regarding what is meant by "rapid test instrument", cf. that instruments for analysing rapid tests are to be procured and the wording "one analysis kit", cf. minimum requirement F.2 in the requirement specifications. In order to procure an instrument that meets the Contracting Authority"s needs, it is necessary to specify what this entails, so that it is sufficiently clear to the tenderers what the Contracting Authority"s needs are.

         The Contracting Authority will begin a new procurement process and expects to announce a new contest in the month of March 2023.
