De aanvullende opdrachten dienen door de oorspronkelijke opdrachtnemer conform art. 2.163d Aanbestedingswet (een aanvullende noodzakelijk geworden wijziging ex art. 72 lid 1 onder b van de Richtlijn 2014/24/EU) te worden uitgevoerd.

The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons

Explanation:

Het is momenteel niet mogelijk om van leverancier te veranderen vanwege de aanzienlijke impact van economische en technische factoren. Vanwege de bescherming van intellectuele eigendomsrechten is het niet mogelijk voor de andere leverancier om werkzaamheden uit te voeren in de applicatie van de huidige leverancier. Deze belemmering heeft directe gevolgen en leidt tot het stopzetten van alle Gisib-gerelateerde projecten. De economische schade die hierdoor ontstaat voor assetmanagement en gemeentelijke ketenpartners is van een aanzienlijke omvang en moeilijk te overzien.

Voor een verdere onderbouwing zie het bijgevoegde document. Betreft een vrijwillige transparantie vooraf. De overeenkomst wordt getekend op 3 juli (na de Alcatel periode) .
