Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Le ripercussioni sull’attività volativa dell’emergenza sanitaria dovuta alla diffusione del virus COVID-19 hanno reso necessario introdurre, ai sensi dell’art. 106 c. 1 lett. c D.Lgs. 50/16, una struttura contrattuale maggiormente flessibile, che consentisse di tenere conto dei mutamenti degli scenari di traffico aeroportuale non prevedibili e delle conseguenti differenti modalità di svolgimento del servizio. Anche in ipotesi di completo superamento dell’emergenza sanitaria, la modularità della struttura contrattuale consente di gestire differenti assetti del servizio di pulizia aeroportuale maggiormente rispondenti al verificarsi di mutate esigenze tecnico-organizzative in un quadro post pandemico cd “new normal”.
