          Opzione di incremento quantitativo di cui all’art. 120, c. 9, del D. Lgs. 36/2023

          Qualora, in corso di esecuzione, si renda necessario un aumento delle prestazioni fino alla concorrenza del quinto dell’importo dell’Accordo Quadro, S.C.R. Piemonte S.p.A., ai sensi dell’art. 120, c. 9, del Codice, può imporre all"appaltatore l’esecuzione alle condizioni originariamente previste. In tal caso l’appaltatore non può far valere il diritto alla risoluzione del contratto.

          Opzione di proroga tecnica di cui all’art. 120, c. 10, del D. Lgs. 36/2023

          La durata del contratto in corso di esecuzione potrà essere modificata per il tempo strettamente necessario alla conclusione delle procedure per l’individuazione del nuovo contraente ai sensi dell’art. 120, comma 10, del Codice appalti. In tal caso il contraente è tenuto all’esecuzione della fornitura oggetto del contratto agli stessi - o più favorevoli - prezzi, patti e condizioni per la durata di 6 mesi.

          Opzione di estensione temporale a parità di importo contrattuale

          Nella sola ipotesi in cui alla scadenza del termine di cui all’art. 3.1 del disciplinare non sia esaurito l’importo stabilito per ciascun Lotto, anche eventualmente incrementato, l’Accordo Quadro potrà essere esteso per i Lotti non esauriti fino ad un massimo di ulteriori 6 (sei) mesi e sino alla concorrenza dell’importo massimo spendibile del contratto, previa comunicazione scritta da inviarsi al Fornitore da parte di S.C.R. Piemonte.
