          E’ prevista la facoltà per CEM Ambiente di disporre la ripetizione dei medesimi servizi estendendone l’esecuzione a piattaforme ecologiche o centri di raccolta di altri Comuni Soci di CEM Ambiente o di Comuni che nel corso di durata contrattuale dovessero assumere la qualifica di socio e conseguentemente disporre l’affidamento in house providing in favore di CEM Ambiente dell’intero ciclo di gestione del rifiuto urbano ed assimilato, nel rispetto delle condizioni e delle prescrizioni stabilite dall’art. 106 comma 7 del D.Lgs. 50/2016 e fino alla concorrenza del 50% del valore del contratto.

          A prescindere da quanto sopra specificato, è in ogni caso prevista, per tutta la durata del contratto, la facoltà unilaterale per CEM Ambiente di estendere / ridurre l’affidamento della custodia e conduzione di piattaforme ecologiche e centri di raccolta, ferme le complessive condizioni tecniche ed organizzative, entro il limite del 20% (venti per cento) del valore del contratto, (il cd. quinto d’obbligo).
