        Alla scadenza del contratto dei 24 mesi, l’aggiudicatario, a richiesta scritta della Stazione Appaltante sarà tenuto a proseguire nella gestione del servizio oggetto dell’appalto fino ad ulteriori 12 mesi o fino all’entrata in servizio del nuovo affidatario, alle stesse condizioni economiche e gestionali previste nel contratto.

        Eventuali varianti in aumento o in diminuzione del contratto, verranno eseguite secondo le modalità di cui all"art. 106 del D.lgs. n. 50/2016 in particolare in base al comma 12: “La Stazione Appaltante, qualora in corso di esecuzione si renda necessario un aumento o una diminuzione delle prestazioni fino a concorrenza del quinto dell"importo del contratto può imporre all’appaltatore l’esecuzione alle stesse condizioni previste nel contratto originario”. In tal caso l"appaltatore non può far valere il diritto di risoluzione del contratto.

        In ogni caso le eventuali prestazioni che dovessero rendersi necessarie per sopravvenute esigenze, ove non diversamente disposto, saranno compensate con corrispettivi calcolati con gli stessi criteri di determinazione dell’importo a base di gara e assoggettati al medesimo ribasso offerto dal soggetto affidatario.
