Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Für die Durchführung der Verlegung von Kabelkanälen werden zusätzliche Leistungen notwendig. Anstelle von Betonkabelkanälen müssen teilweise aufgeständerte GFK-Kanäle zum Einsatz kommen. Die Änderungen ergeben sich aufgrund fehlender Sperrpausen. Durch einen Konflikt mit der Planung der Sperrpausen müssen aufgeständerte Kunststoffkabelkanäle verwendet werden. Da der AN mit der Durchführung der Kabeltiefbauarbeiten beauftragt ist, ist ein AN Wechsel für die betroffenen Bereiche aus technischen Gründen nicht möglich. Die zusätzliche Leistung ist zwingend erforderlich, um den Bauablauf nicht zu stören bzw. zeitlich zu verzögern. Durch einen Wechsel des AN und einer damit einhergehenden Aufteilung der Kabeltiefbauarbeiten würden nicht mehr funktionsfähige Auftragseinheiten und Schwierigkeiten beim Ineinandergreifen der getrennt vergebenen Kabeltiefbauarbeiten entstehen. Der AN ist bereits mit der Durchführung der Kabeltiefbauarbeiten beauftragt. Bei einer getrennten Vergabe für die von der zusätzlichen Leistung betroffenen Bereiche würde es zu Zusatzkosten kommen, da honorarminimierende Faktoren, wie Synergieeffekte durch eine einheitliche Leistungserbringung verloren gehen würden. Außerdem ist eine getrennte Vergabe aus technischen Gründen nicht möglich. Bei einem vollständigen AN Wechsel für die gesamten Kabeltiefbauarbeiten käme es zu beträchtlichen Zusatzkosten, da dem AN nicht ersparte Mehraufwendungen erstattet werden müssten.
