         Il servizio da appaltare costituisce il segmento di quanto definito nella Direttiva MIUR del 30.11.01 prot. 3390, ove si distingue tra assistenza di base (di competenza dei Collaboratori ATA della scuola) e assistenza specialistica (di competenza degli Enti Locali).

         Gli standard gestionali e strutturali cui deve conformarsi il servizio sono indicati nella legislazione statale e regionale (in particolare L. 104/92, Direttiva MIUR del 30.11.01 prot. 3390, D.Lgs. 112/1998, Decreto interministeriale n. 182 del 29/12/2020).

         Il servizio, in applicazione del quadro normativo nazionale e regionale che riconosce nella scuola un contesto formativo adeguato anche per i ragazzi con disabilità, deve tendere a garantirne l"integrazione ed il diritto allo studio, e pertanto deve presupporre il perseguimento delle finalità indicate all’art.1 del Capitolato speciale d’appalto allegato e secondo modalità e specifiche tecniche riportate nel capitolato medesimo.

         b) Avere disponibilità in organico di personale qualificato al soddisfacimento del servizio in possesso dei requisiti minimi richiesti all"art. 9 del Capitolato speciale di appalto.
