         L’appalto è aggiudicato da Sport e Salute S.p.A. che agisce quale Centrale di Committenza, ai sensi del combinato disposto dell’art. 3, co. 1, lett. l), n. 2), dell’art. 37, co. 6 e 7, lett. b), e dell’art. 38, co. 1-bis, del D.Lgs. n. 50/2016, per conto degli enti pubblici preposti all’attuazione degli Interventi di recupero delle aree urbane tramite la realizzazione e l’adeguamento di impianti sportivi (definiti Soggetti Attuatori ai sensi dell’art. 1, co. 4, lett. o), del D.L. n. 77/2021, convertito in L. n. 108/2021)

         La procedura si articola in 2 Lotti Geografici aventi ad oggetto lavori in appalto integrato sulla base del progetto di fattibilità tecnica ed economica, ai sensi dell’art. 48, co. 5, del D.L. n. 77/2021, ovvero del progetto definitivo, in virtù del regime di sospensione transitoria del divieto di cui all’art. 59, co. 1, quarto periodo, del D.Lgs. n. 50/2016 :

         A seguito della assegnazione del singolo Lotto e della stipula del relativo Accordo Quadro con Sport e Salute Sp.A., i Soggetti Attuatori potranno stipulare con l’aggiudicatario, senza riapertura del confronto competitivo, Contratti Specifici aventi ad oggetto le prestazioni dedotte nell’Accordo Quadro, come meglio indicato nel Disciplinare di gara.
