It was the intention of the Contracting Authority to conduct a new procurement process for the provision of these services but, due to changes within the Contracting Authority’s operational environment, the scope of any new tender cannot be determined at this time.

Due to resourcing, strategy and other complexities, it is not possible to define the new requirement for this service and therefore it is anticipated that a new tender process will not take place until early 2025 at the earliest. On that basis the continuation of the current contract is essential to the Contracting Authority’s operations. On that basis a further Modification Notice in accordance with under Art. 72(1)(c) of Directive 2014/24/EU is now required, to extend the present contract by a further 50% in value.

VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The existing services contract had previously been modified (TED Reference: 2022/S 093-257302) in May 2022. This further contract modification will have the effect of extending the existing services contract as described at II.2.4 above for a period of up to 18 months from September 2023..

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

It was the intention of the Contracting Authority to conduct a new procuremen process for the provision of these services but, due to changes within the Contracting Authority’s operational environment, the scope of any new tender cannot be determined at this time.
