Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Die zwei Gleise der neuen Bahntrasse verlaufen in einem Abstand von ca. 100 m in nördlicher Lage an der Siedlung Ödenhub (Gemeinde Großkarolienenfeld) vorbei. Dabei wird die bestehende Gemeindeverbindungsstraße gekreuzt. Hierfür ist ein Brückbauwerk (EÜ Ödenhub) erforderlich. Die Straße musste in der ursprünglichen Planung dafür abgesenkt aber in der Lage nicht verändert werden. Zwischenzeitlich wurde auf einem benachbartem Grundstück jedoch ein Milchviehstall errichtet. In Folge dessen ist es erforderlich die bereits erstellte Planung der Straße und der Brücke an die aktuelle Bestandssituation anzupassen. Die Straße und die Brücke müssen in der Lage nun verschoben werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Dem verhältnismäßig geringen Umplanungsaufwand, ständen beim einem Wechsel des Bearbeiters sehr große zeitliche und damit auch große Kostenaufwände gegenüber. Für die Planungen sind umfangreiche Grundlagendermittlungen, Erhebungen von Zwangspunkten, die Einarbeitung in die Planungsstände, Abstimmungen mit Dritten und der sehr vielen Projektbeteiligten, Ortskenntnisse, System/-Softwarezugänge, Schulungen, Prozesse etc. notwendig. Des Weiteren liegen dem AN die ursprünglichen Planunterlagen (2D, 3D, BIM) vollständig vor.
