II.2.4)Description of the procurement at the time of conclusion of the contract:

L’appalto consiste essenzialmente nel servizio di assistenza completa agli Impianti di Condizionamento (IdC) e ai Convertitori Statici (CVS) di tutti i rotabili indicati nel Capitolato Tecnico Organizzativo (CTO), cui si rimanda, e dovrà essere comprensivo della Manutenzione Programmata, Messa in Servizio e relativa assistenza tecnica, nonché dell’eventuale Manutenzione correttiva, ed erogato secondo l’articolazione organizzativa, tecnica ed operativa descritta nel CTO. Inoltre, dovranno essere svolte tutte le attività necessarie per assicurare il buon funzionamento, il mantenimento in efficienza ed eventuali miglioramenti tecnici in corso d’opera degli IdC e dei CVS. Ai fini di assicurare il regolare funzionamento, dovrà essere garantita anche l’efficienza dell’elettronica di comando e controllo dell’impianto clima, con le relative verifiche e manutenzioni delle connessioni elettriche di alimentazione. È prevista, inoltre, la possibilità di esercitare delle opzioni relative alla modifica dei tubi di scarico degli impianti di condizionamento delle carrozze Media Distanza (MD)e alle attività di miglioramento/efficientamento degli impianti di condizionamento nell’ambito della prestazione base contrattuale di 24 mesi.

Natura e portata delle modifiche (con indicazione di eventuali modifiche contrattuali precedenti):

Ai sensi dell’art. 106 comma 1 c) del D.lgs. 50/20106, si è resa necessaria, attraverso l’esecuzione di un Atto Modificativo Integrativo del valore di € 356.400,00 (a seguito di richiesta di offerta all’appaltatore), per l’esecuzione del servizio sostituzione batterie condensanti. Il servizio fa riferimento a prestazioni impreviste e imprevedibili che non alterano la natura generale del contratto.

L’esecuzione di tali attività è stata affidata al contraente originale poiché un cambio di contraente sarebbe risultato impraticabile per motivi tecnici ed economici.

Descrizione delle circostanze che hanno reso necessaria la modifica e spiegazione della natura imprevista di tali circostanze:Ai sensi dell’art. 106 comma 1 lett c) del D.Lgs. 50/2016 , Trattasi di Atto Modificativo Integrativo del contratto ancora vigente per un valore di € 356.400,00, al fine di integrare nel perimetro del contratto originario il servizio di sostituzione batterie condensanti dovuto ad un incremento rilevante di malfunzionamenti dei diversi gruppi di condizionamento.
