Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2

GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der

Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist

kann eine Unwirksamkeit nicht mehr festgestellt werden.

VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Nachtrag 56: Die Lage der Entrauchungsöffnungen haben sich geändert. Für die neue Lage ist die Tragwerksplanung im Bereich der

Öffnungen erneut auszuführen, um die mit der nuene Lage verbundenen Randbedingungen zu erfassen und zu berücksichtigen.

Im weiteren hat sich die Menge der Kernbohrungen für die Wand- und Deckendurchführungen erhöht. Die enstprechenden

Nachrechnungen für die Bestandssubstanz ist für die zusätzlichen Kernbohrungen auszuführen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund der Komplexität und Umfang der Planung führt ein Wechsel des AN zu Verlust der Synergieeffekt und zu zeitlichenZwängen. Im Weiteren ist der AN vollumfänglich in die bisherige Planung eingebunden und muss sich nicht zeitaufwendig in diesehr komplexen Zusammenhänge der Baumaßnahme und die Örtlichkeiten einarbeiten. Der AN besteht aus einerPlanungsgemeinschaft zweier Planungsbüros. Ein Wechsel würde die Leistungsbetreuung und Mängelansprüche gegenüber demAN sehr erschweren, eine Klare Schnittstelle ist für die Nachtragsleistungen gegenüber den Leistungen des Vertrages ist nicht zudefinier. Die Planungen greifen eng ineinader. Ein Wechsel würde zu zeitlichen Zwängen der Gesamtmaßnahme führen und dieKosten enorm erhöhen.
